I should be grateful if you could supply me with details of all communications transmitted and received between the Devon and Somerset Fire and Rescue Service, and Peverel Retirement, now known as First Port Retirement, Queensway House, 11 Queensway, New Milton, Hampshire BH25 5NR.

I specifically request details of all surveys, letters and electronic communications between these two parties relating to the premises at the Retirement Home known as Brooklands, Alexandra Road, Dawlish, Devon EX7 9JT and Brooklands, Lawn Terrace, Dawlish, Devon EX7 9JT.

Please include all communications between 1st January 2011 to date only.

FREEDOM OF INFORMATION ACT 2000

 

I write further to your request for information and our acknowledgement of
22 June 2015.

 

We have to balance being open and transparent with our statutory
relationship with property owners and their rights to confidentiality and
we are of the opinion that we will have to carry out further work in order
to ascertain whether we can disclose the information requested. The law
says we can have a “reasonable” extension of time to consider the public
interest test and this should be no more than an extra 20 working days,
which is 40 working days in total to deal with the request. Therefore,
please be advised that we will hold this test on 29 July 2015 and will
write to you shortly after this with our decision.

I write further to our last email of 16 July 2015.

 

Decision

The information you have requested is held by the Devon & Somerset Fire &
Rescue Service (DSFRS).

 

Please find below the detail of the information you have requested along
with our response.

 

Request

I should be grateful if you could supply me with details of all
communications transmitted and received between the Devon and Somerset
Fire and Rescue Service, and Peverel Retirement, now known as First Port
Retirement, Queensway House, 11 Queensway, New Milton, Hampshire BH25 5NR.

 

I specifically request details of all surveys, letters and electronic
communications between these two parties relating to the premises at the
Retirement Home known as Brooklands, Alexandra Road, Dawlish, Devon EX7
9JT and Brooklands, Lawn Terrace, Dawlish, Devon EX7 9JT.

 

Please include all communications between 1st January 2011 to date only.

 

Response
As previously stated, we have to balance being open and transparent with
our statutory relationship with property owners and their rights to
confidentiality. After due consideration in carrying out our public
interest test, this means that on this occasion we can give you a summary
of our information/actions but we can’t provide a copy of the
communications.

 

DSFRS have given advice on the suitability of applying a ‘stay put’ or
‘delayed evacuation’ policy to premises such as those managed by the
company involved. We have outlined action to be taken where it has been
identified that a ‘stay put’ policy is not appropriate, and also explained
that it is the duty of the Responsible Person, in this case Port First
Retirement to ensure suitable measures are put in place whether a ‘stay
put’ policy is applicable or not. DSFRS work with all types of businesses
to ensure they are compliant with fire safety requirements, and if
following identification of deficiencies and the giving of advice,
suitable and sufficient action is not taken, DSFRS will take more robust
action. This may include Enforcement Notices but we can confirm that we
have not taken any enforcement or legal action, in respect of the premises
identified in this FOI request.

 

It should be noted that the legislation covering this property is split
between the Regulatory Reform Fire Safety Order 2005 (covering the common
areas) enforced by the Fire Authority and the Housing Act 2004 (covering
the flats) enforced by Local Authority Housing Standards. We have issued
appropriate advice to First Port concerning their application of a ‘stay
put’ or ‘delayed evacuation’ policy in the premises as outlined above.

something for you.

 

Review

You have the right to ask us to review this decision.  If you wish to do
this please set out your grounds for review in writing and send them to
the Information Officer at the Service Headquarters address or e-mail

Appeals

If you are still dissatisfied after a Service review you have the right to
appeal to the Information Commissioner at the Information Commissioner’s
