Dear Ms Walton,
Thank you for your email dated 5 May requesting all communications between
the Department and Education Otherwise.

The Department holds the information you have requested. However, the
Department estimates that the cost of complying with your request would
exceed the cost threshold applicable to central Government. This is -L-600
and represents the estimated cost of one person spending 3 1/2 working
days locating, retrieving and extracting the information.

Under section 12 of the Act the Department is therefore not obliged to
comply with your request and will not be processing it further.

However, if you were to make a new request for a narrower category of
information or limit the scope of your request, the Department may be able
to comply with your request within the cost limit, although I cannot
guarantee that this will be the case.

It may help if I outline some possible ways of narrowing your request.
Education Otherwise communicates with the Department across a wide range
of issues. If you were interested in a particular subject matter for
which the Department is responsible then that would help us provide you
with the information requested.

Thank you for your email, received 8 June, following Iain Campbell's reply
to you on 4 June advising that your request for communications between the
Department and Education Otherwise exceeded the cost threshold for a
response.

Thank you for amending your request. Unfortunately, most of the
communication with Education Otherwise is concerning some aspect of home
education and would still therefore exceed the cost threshold.

Would it be acceptable for us to consider providing details of all
communications since 1 May 2008 between Education Otherwise and the policy
team within the Department (Independent school partnerships and strategy
team) that has responsibility for home education?

This can't be right, this is just part of your original request. I would refer to internal review, they must be trying it on.

My initial request was simple enough for clarification to be requested upon reciept , to wait the full 20 days on each occasion before asking for further clarification is nothing short of contemptuous.

No Tania they have released nothing. As the information I requested is public property , as the people charged with collating and releasing it are public servants living off the taxes of those awaiting the information I find the contemptuous manner in which these servants have dealt with my request despicable .

review of case reference 2009/0061650 about communications between the
policy team responsible for home education and Education Otherwise. I
should like to apologise for the delay in replying. The Department is
aware that it has missed the statutory deadline for reply and is in breach
of its obligations under the Act. I very much regret this - the
Department should meet its obligations under the Act.

While I appreciate that it is in no way a justification I should like to
explain that the Department makes every effort to meet deadlines, but the
delay in responding in this case has been due to the unusual volume of
requests the Department has received in recent months. The Information
Commissioner has been informed of the situation.

The Department normally considers requests for an internal review
following a response being sent to you. I am currently dealing with your
request and a reply will be sent to you as soon as possible. If you are
unhappy with that reply please contact me in writing and an internal
review will be considered.

I can confirm that your request for an internal review of case reference
2009/0057579 (communications with Nektus) is being arranged.

Thanks for the note I have a daily ritual of coming and seeing my few dusty FOI's and will be copying the for the Home ed inquiry (and am happy for anybody else to raise them) along with a request that if they pursue them with dcsf that they inform me of any progress. I must be getting close to a place in the record books having four neglected requests or are there people with more ?

I have two requests awaiting internal review, one asking for evidence in support of the Bad Man Report is outstanding since 1st July and has been referred to the Information Commissioner.

I have a theory that they haven't answered anything where the actual word evidence is used. Yet to check that out though.
