- All correspondence and communication (letters, emails, memos etc.) between West Midlands Police and staff of the University of Warwick, from Dec. 2, 2014, until the current day.

I would appreciate any information on these matters you are able to provide. I understand that this information does not have to be in document form unless specifically requested, and that it is the department’s responsibility to provide me with the information I require.

RESPONSE

 

We are unable to provide this information within the threshold set by the
FOI Act. To retrieve this information, our ICT data supplier would have to
undertake a search of every officer and staff account for any emails or
stored correspondence to Warwick University. We would also have to ask
every member of staff to provide any written correspondence with Warwick
University. Please note that approaching each member of West Midlands
Police staff (of which there are 11, 296) would exceed the appropriate
limit (FOIA, s.12 (1)). However please consult the remainder of the
document to see what can be provided within the cost threshold.

Therefore, the cost of compliance with your request is above the amount to
which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12 of the Freedom of information Act 2000. For West Midlands
Police, the appropriate limit is set at £450, as prescribed by the Freedom
of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004, S.I. 3244.

 

A public authority which, in relation to any request for information, is
relying on a claim that section 12 or section 14 applies must, within the
time for complying with Section 1(1), give the applicant a notice stating
that fact. In accordance with the Freedom of Information Act 2000, this
letter acts as a refusal notice.

 

In accordance with Section 16 of the Freedom of Information Act, I am
happy to look at ways in which you can refine your request in order to
have access to some of the information you have requested. Although you do
not have to tell me, is there a specific incident that you require
information about? If you are able to disclose this, then we may be able
to see which department / officers were involved. We could then search
their accounts and ask them to provide any written correspondence, thereby
refining your request to a more manageable level.

 

To enable us to proceed with your request I would be grateful if you could
confirm whether you wish us to provide the information outlined above.
After receiving your reply, your request will be considered and you will

Thank you for your response, I understand and agree with your concerns.

I assume there are set departments or individuals within West Midlands Police who are mandated to deal with correspondence between the University and the force. If you know or can find out who they are, I would be happy to change my request to be limited to those individuals (as well as those listed blow this paragraph). Obviously the University isn't going to have contact with most low-level officers. In particular, I'm looking for correspondence regarding the incident on Dec. 3 when police were called to deal with an assault on campus. There is no doubt that the University has had correspondence with the force over that incident, and that correspondence has most probably been kept up throughout the bail and trial periods (7-9 July, 2015) following that incident.

I would also like the force to request individual officers involved on the day to provide any correspondence (e.g. written) they've had with the University. In particular, PC Simon Lloyd (0796), PC Chris Whitehead, PC Marc Forth, and PC Simpson, who were all present during the event.

West Midlands Police will neither confirm nor deny that we hold any of the
requested information. This letter serves as a Refusal Notice under
Section 17 of the Freedom of Information Act 2000 (the Act). You may wish
to consult the Independent Police Complaints Commission who are
investigating the incident and will produce a report outlining their

REASONS FOR DECISION

 

The Freedom of Information Act places two responsibilities on public
authorities, the first of which is to confirm what information it holds
and secondly to then disclose that information, unless exemptions apply.

 

In this case West Midlands Police will neither confirm nor deny the
existence of any relevant data by virtue of Section 30 (3) Investigations
and Proceedings Conducted by Public Authorities.
