We have considered your request under the Freedom of Information Act 2000
(FOIA).
Please note that while you indicated that focus should be placed on the
first part of your request if a cost exemption will be reached for the
request, we are writing to confirm that an exemption applies to the
request as a whole. Given this, we would like to confirm if you would like
us to proceed with the first part of the request only.
In line with the above, we can’t provide the information you requested.
This is because of the amount of data you’ve asked for and the work that
would be involved. Under the FOIA there’s an exemption for requests where
it would cost the public authority more than £450 (the ‘appropriate
limit’) to process - equivalent to two and half days’ (18 hours or 1080
minutes) work.
The cost of your request
To estimate the cost, we can take into account locating, retrieving and
extracting the information requested.
We did a basic search to identify the number of search results based on
the request above and estimate about 8000 plus search results from 1
November 2024 to 5 February 2025 that would need to be reviewed.
If it took us just 5 minutes to locate, retrieve and extract each of the
search results, it would take us about 667 hours to process your request.
Based on an hourly rate of £25 per hour (which is set by the Freedom of
Information (Fees and Appropriate Limit) Regulations 2004) this would cost
£16,667 which would exceed the appropriate limit of £450 (18 hours).
The exemption
Under the FOIA, the specific exemption which we believe applies is at
section 12. This states that we are not required to comply with a request
if we estimate that the cost of doing so would exceed the appropriate
limit.
Advice and assistance
In line with the information above, we may be able to provide the first
part of the information requested that is emails between the GMC and
either Professor Leng, the Leng Review or any other representative of the
review from the 1 November 2024 within the cost limit.
