Common Law Duty of Care in HE

Royal College of Art did not have the information requested.

"Universities have a general duty of care to their students - not to cause harm by careless acts or omissions – commensurate with their role and capabilities as settings for adult education" (Universities UK, 2023).

On  20 July 2023 you submitted the following request for information to
the Royal College of Art, please find our response below. 

1. Please supply any internal or external university documentation that
explains the nature and extent of this Common Law duty of care, placed on
every member of staff, and owed to each enrolled student.

Our response:

This information is withheld under s.12 of the Freedom of Information Act
as it would take over the appropriate time limit of 18 hours to retrieve
the information requested. This is because the duty of care is referred to
in various policies and guidance documents available to staff in the
provision of our services and the College does not hold a specific
document that explains this in the singular. In the provision of advice
and assistance you may it helpful to consult our policies [1]here.

Academic Appeal policy

Fee refund policy

Health and safety policy

If you are unhappy with the way your request has been handled, you may
make a complaint by writing to [2][Royal College of Art request email]. Your complaint will be
considered by an adjudicator who was not involved in the original
consideration of your request.

If you are not content with the outcome of your complaint, you may then
