Common Law Duty of Care in HE
Dear Cardiff Metropolitan University,
"Universities have a general duty of care to their students - not to cause harm by careless acts or omissions – commensurate with their role and capabilities as settings for adult education" (Universities UK, 2023).
Please supply any internal or external university documentation that explains the nature and extent of this Common Law duty of care, placed on every member of staff, and owed to each enrolled student.

Information Act 2000.
You have asked for:
Any internal or external university documentation that explains the nature
and extent of this Common Law duty of care, placed on every member of
staff, and owed to each enrolled student.
We seek some further clarification on the request that has been made. This
seems to suggest that Universities UK has legislative powers, yet this is
not the case. Universities UK is a member-led organisation, which provides
a collective voice for over 140 universities in the UK – further
information is available at [1]Introducing UUK (universitiesuk.ac.uk).
Universities have a general duty of care “to deliver educational and
pastoral services to the standard of an ordinarily competent institution”
and that in doing so “they are expected to act reasonably to protect the
health, safety and welfare of their students”.
Please can you clarify your request in terms of any further context so
that we can provide any further information?

Dear Gillian,
The University does not have guidance specifically and solely on the common law duty of care owed to students. However, the University has a general duty of care at common law: To deliver its educational and pastoral services to the standard of the ordinarily competent institution, and, in carrying out its services and functions, to act reasonably to protect the health, safety and welfare of its students. The University provides a welfare service to students which includes confidential guidance and support on health and disability as it may affect their academic studies and progression. This service includes an effective triage system by which the University can identify those cases in which it is able to provide appropriate assistance itself, and those in which it needs to direct / refer students to external specialist and/or emergency support services.
The University also has a duty under the Health and Safety at Work Act 1974 to do everything reasonably practicable to ensure the health and safety of their students.
In order to assist it to discharge its duty of care, the University has in place effective and robust systems, policies and procedures for supporting and managing students, and provides training and awareness-raising for staff.
