Common law and constables oath

Kirsty Eccles made this Freedom of Information request to Lancashire Constabulary This request has been closed to new correspondence. Contact us if you think it should be reopened.

Response to this request is long overdue. By law, under all circumstances, Lancashire Constabulary should have responded by now (details). You can complain by requesting an internal review.

Dear Lancashire Constabulary,

On 19th March 2018 I sent you a freedom of information request.

My request was quite a simple one....

"As the United Kingdom of great Britain is a common law jurisdiction, is it true that constables swear an oath to uphold the law, therein meaning the 'common law' of the land of great Britain, as opposed to corporate rules or statutes?"

Yet all you responded with is a copy of the police oath which mentions the "law" but not 'which' law.

I then asked for an internal review requesting you confirm if the "law" you refer to Is Common law or Statute law, which, unfortunately and unprofessionally you chose to ignore.

It really is a simple question and for research purposes I would like an answer please.

A full history of my FOI request and all correspondence is available on the Internet at this address:

Yours faithfully,

Kirsty Eccles

Information assurance unit,

Dear Ms Eccles

Further to your email below it appears there may be some mix-up regarding reference numbers.

Your Freedom of Information Request "As the United Kingdom of great Britain is a common law jurisdiction, is it true that constables swear an oath to uphold the law, therein meaning the 'common law' of the land of great Britain, as opposed to corporate rules or statutes?" was submitted under an alternative reference [email address] to which we responded on 18/04/18. On 20/04/18 you requested an internal review which was subsequently recorded as our reference 1378/18.

We do not have any record of [FOI #490864 email] which is referred to in your email below and apologise that we are unable to assist you further in this regard.

Regards

Dear Information assurance unit

On 20th April 2018 I sent you the following request...

"Dear Lancashire Constabulary,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Lancashire Constabulary's handling of my FOI request 'Common law and constables oath'.

My request was quite a simple one....

"As the United Kingdom of great Britain is a common law jurisdiction, is it true that constables swear an oath to uphold the law, therein meaning the 'common law' of the land of great Britain, as opposed to corporate rules or statutes?"

Yet all you responded with is a copy of the police oath which mentions the "law" but not which law.

Is it Common law or Statute law?

It really is a simple question and as a member of the public I have a right to know."

To which you responded "Please be advised that we have booked your request for an internal review onto our systems under the reference number 1378/18. We will respond to your internal review in due course."

I have now been waiting over three months for an internal review.
As you are deliberately delaying matters I shall now pass this file to the ICO.

Yours sincerely,

Kirsty Eccles
