Common Good funds: assets, value and spending

We're waiting for Ally Tibbitt to read recent responses and update the status.

Dear South Ayrshire Council,

Please treat this email as a Freedom of Information request.

I understand that the council must put together a Common Good Asset register and specific account for Common Good funds.

In this context, I would be grateful if you could supply the following information from the council:

1. The Net Asset Value of the Common Good Funds administered by the council in these financial years:
* 2007/08
* 2012/13
* 2017/18
* 2020/21
* 2021/22 (if known)

2. The online location of all available Common Good accounts for the council.

3. The online location of the Common Good funds asset register. If it is not online, then please supply it in an excel format, or another machine readable, open format. It should not be supplied in pdf format files.

4. An itemised breakdown of all debits from the Common Good account for the last three financial years where finalised records are available, showing the recipient, and summary purpose of each debit. This should be supplied in Microsoft excel format, or another machine readable, open format. It should not be supplied in pdf format files.

5. An itemised list of any Common Good assets that have been sold or otherwise removed from the accounts in the last three financial years where finalised records are available. This should show the revenue raised by the sale, and details of the buyer. In the case of assets that were otherwise removed from the Common Good fund, please provide a short summary explanation of why they were removed. This should be supplied in Microsoft excel format, or another machine readable, open format. It should not be supplied in pdf format files.

6. An itemised list of any Common Good assets that have been added to the register in the last three financial years where finalised records are available. This should include the value of the asset and a description or location of the asset, and the date it was added. This should be supplied in Microsoft excel format, or another machine readable, open format. It should not be supplied in pdf format files.

7. An itemised list of any Common Good assets that are currently leased to other organisations, including other council departments or public sector bodies. This list should include summary details of the start and end date of the lease, the lease holder, and the annual revenue that is raised from the lease. This should be supplied in Microsoft excel format, or another machine readable, open format. It should not be supplied in pdf format files.

I look forward to hearing from you in due course.

Yours faithfully,

Ally Tibbitt

FOI, South Ayrshire Council

Good afternoon

Thank you for your email seeking an internal review of the Council's handling of your information request, I note that your basis for Review is that the Council has failed to provide a response to your request within the statutory 20 working days.

I will now take your request forward, but I would like to clarify that as the information has not yet been issued to you, it will be issued as part of my Review investigation. In the event that you are dissatisfied with the response you receive, any further concerns would be considered by the Scottish Information Commissioner. Alternatively, if you wish to wait to receive the response this will afford you the opportunity to seek an internal review of the response as a whole, with the option of seeking investigation from the OSIC thereafter.

I would be grateful if you can confirm that you understand the position, and wish to pursue an Internal Review at this time. Meantime, I have contacted the relevant Council services seeking the information they hold to provide a response, and I would apologise for the ongoing delays you are currently experiencing.

Regards
Deborah McVey

FOI, South Ayrshire Council

Good afternoon

Thank you for your recent enquiry which was given the above reference
number.

1. The Net Asset Value of the Common Good Funds administered by the council in these financial years: a. 2007/08 b. 2012/13 c. 2017/18 d. 2020/21 e. 2021/22 (if known)

Net Assets as at per audited annual accounts.

31/3/08 - £17.171m

31/3/13 - £18.922m

31/3/18 - £16.546m

31/3/21 - draft annual accounts not yet published (available after 30^th
June 2022).

2. The online location of all available Common Good accounts for the council.

An online asset register is currently being developed by the Council.

3. The online location of the Common Good funds asset register. If it is not online, then please supply it in an excel format, or another machine readable, open format. It should not be supplied in pdf format files.

Latest Leadership Panel Report item 5a of 8^th March 2022 provides a strategic review of assets held in the Common Good Funds together with a list of these assets.

4. An itemised breakdown of all debits from the Common Good account for the last three financial years where finalised records are available, showing the recipient, and summary purpose of each debit. This should be supplied in Microsoft excel format, or another machine readable, open format. It should not be supplied in pdf format files.

We don’t record the information at the level of detail requested therefore an analysis of all invoices would require to be undertaken which would likely take weeks.

There have been no disposals/assets removed in the last three financial years – information of this type is available in the Common Good Accounts and associated notes contained in the Councils annual accounts.

There have been no assets added to the Common good account in the last three years – information of this type is available in the Common Good Accounts and associated notes contained in the Councils annual accounts.

This is currently being prepared by the service however it is not yet
available at this time.

If you are dissatisfied with the handling of your request you can ask for
a review.  A request for a review must be submitted within 40 working days
and should be put in writing to Deborah McVey, Information Governance Team
Leader, South Ayrshire Council, County Buildings, Wellington Square, Ayr
KA7 1DR, Tel: 01292 612223, Email: [1][South Ayrshire Council request
email].  If you remain dissatisfied after a review, you have the right to
apply to the Scottish Information Commissioner for a decision. This must
be submitted within 6 months after the review and should be put in writing
to the Scottish Information Commissioner at Kinburn Castle, Doubledykes
Road, St. Andrews, Fife KY16 9DS, Tel: 01334 464610 Email: [2][email
address] or use the online portal
