Common Assault

We're waiting for Louise to read recent responses and update the status.

Dear Merseyside Police,

Can you please provide information on the following points. All are in relation to an arrest under ‘common assault’

1: Where an arrest of common assault was disposed of via ‘No Further Action’ or commonly abbreviated to ‘NFA’: What is the retention period of these records in relation to the event/arrest ?

2:Where the outcome was NFA: Will these records be held on local police records or the PNC?

3: Where the outcome was NFA: If these records can be deleted will they be automatically be disposed of once the retention period has been reached or is an application from the individual necessary to Merseyside police necessary for deletion?

Dear Louise

 

Thank you for your Freedom of Information request concerning ‘No Further
Action’ which was received by Merseyside Police yesterday, 13/06/2019. 
This has been allocated the local case reference number CC2019/0805.

 

I note that you have not provided Merseyside Police with your full name. 
Although FOI is generally considered to be “applicant blind”, Section
8(1)(b) of the Freedom Of Information Act states that, in order to be
considered valid, a Freedom of Information request should include “the
name of the applicant.”  The Information Commissioner’s Office has
interpreted this as meaning the real, full name of the applicant should be
used when requesting information and not any other name, for example, a
pseudonym.  This is because the applicant’s identity may be relevant when
considering the use of Section 12(4) or Section 14 FOI Act, for example.

 

Therefore, in order for your application to be processed, may I
respectfully ask that you provide us with your surname.  As soon as this
is received we will proceed with your application until such time this FOI
request will be suspended.
