Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Cornwall Council's handling of my FOI request 'Committee minutes for Report of Working Party on child abuse "child abuse in schools"'.

I am reluctantly asking for a review because there appears to be excessive redaction, insufficient explanation of it and also non provision of minutes that should exist.
Please could you give advice as to why these minutes are not available. Where are these minutes normally kept and why are these missing and are there many missing or are these isolated cases? Have the full council committee been informed that minutes are missing?

I do not believe the extensive redactions can possibly be justified by the only exemption given Section 40 (2)
It is not unfair to release the names such as the author Jane Sloan and co authors, or the members of the working party which Cornwall Council has released elsewhere. Further members of the committees should be public as they were on public business, paid for by the taxpayers, and the meetings were open to the public.
I would not argue with redacting any victims names.
The use of S40 (2) has been taken to absurd extremes.

It does not include " any expression of opinion about the individual and any indication of the intentions of the data controller or any other person in respect of the individual" and is not personal data under the Data Protection Act

Section 40 (2) applies where disclosure of third party personal information would breach any of the Data Protection principles.

The Council has a legal requirement under the Data Protection Act 1998 (“DPA”) to process personal data fairly and lawfully. The Council considers that releasing third party personal information would be unfair and as such a disclosure that would breach Principle One of the DPA.
