Dear NHS Haringey Clinical Commissioning Group,

Under the Freedom of Information Act 2000, could you please provide me with the following information:

- Copies of policies Haringey CCG follows in commissioning care to care agencies in relation to care to be provided by such agencies at the child's home and funded by Haringey CCG
- Copies of policies, legislation and guidance on how families should be heard in the process of choosing an agency
- Copies of policies, legislation and guidance in what instances home care carers or nurses can / cannot be left alone with the child
- Copies of policies, legislation and guidance providing Haringey CCG to refuse families doubling up on the carers / nurses when two adults are required at the property (by this is meant that 2 agency staff are to carry out a shift to enable the parent to leave the property, a practice I understand has been adopted some of the parents of children qualifying for NHS continuing care)
- How many complaints were lodged about Haringey CCG in years 2015, 2016 and 2017
- How many of these complaints resulted in findings that Haringey CCG had acted wrongly, how many were found that Haringey CCG had acted properly

If the decision is made to withhold some of this data using exemptions in the Data Protection Act, please inform me of that fact and cite the exemptions used.

Thank you for your enquiry requesting information under the Freedom of
Information Act 2000.

 

Please find below our response to your request:

 

1.     Copies of policies, legislation and guidance on how families should
be heard in the process of choosing an agency

Parents have the choice through their personal health budget to either
select their own agency and commission it directly through use of a direct
payment, or for the CCG to commission an agency on their behalf. Where a
family opts to have a package commissioned by the CCG, the CCG has a
requests for quotes process whereby they deliver an anonymised profile of
the child to all contracted providers and request quotes for the delivery
of the package. There is no facility for parental involvement in the
choice of agency when the CCG is directly commissioning as the decision
will be made against best price criteria.  Further information on personal

2.     Copies of policies, legislation and guidance in what instances home
care carers or nurses can / cannot be left alone with the child

Policies for this are held by the individual care agency, and any
instances of the carer or nurse being left at home routinely would be
agreed on the basis of the support plan, to meet the assessed needs of the
child.  We are currently reviewing our local continuing care policy and
aim to make this clearer in the next iteration. The CCG do not hold these
policies.

 

3.     Copies of policies, legislation and guidance providing Haringey CCG
to refuse families doubling up on the carers / nurses when two adults are
required at the property (by this is meant that 2 agency staff are to
carry out a shift to enable the parent to leave the property, a practice I
understand has been adopted some of the parents of children qualifying for
NHS continuing care)

Decisions around the appropriateness of providing two carers to allow for
parents to leave the property would be made on an individual basis based
on the needs identified in the assessment, the age of the child, and the
care, as outlined in the support plan and the social care package in
place. For example, where there is a social care package for respite, this
should be used to provide a second carer to allow for parents to have
appropriate cover for them to leave the property. Children’s continuing
care funding is provided in order to meet the care needs of the child or
young person, and this is outlined in the national continuing care
framework. All legislation is publically available and attached to this

are not categorised as the organisation “acted wrongly” or “acted

Dear Mrs Nupponen

 

I apologise as the original wording was not clear as the sentence “All
legislation is publically available and attached to this response” was
added to the response in error. We should I clarified that we are unable
to provide details of specific legislation sections as that information is
not held by the CCG. In determining obligations around Continuing Care we
apply the Framework, which does reference some specific legislation which
is cited within the national document previously provided and which is
available online. Additionally we refer to our statutory duties as a CCG
in determining what we would fund as outlined in the Health and Social
Care Act 2012. We hope this helps, but unfortunately the legislation does
not reference what we do not have a duty to provide, only what we do have
a duty to provide and therefore we are not able to provide specific
legislative paragraphs excluding responsibilities to provide specific
things outside our remit, such as education/housing/childcare etc.
