Information Commissioner's Office

23 January 2015

Case Reference Number IRQ0568376

Dear S Morgan

Request for Information

Thank you for your email of 20 January 2015, in which you have asked:

In your response to an FOI request by somebody else, you made reference to
a "Commissioner's Most Hated List" (1st February 2013 entry at
https://www.whatdotheyknow.com/request/2...).

Please may I have a copy of this list?

Your request has been dealt with in accordance with the Freedom of
Information Act 2000 under the reference number shown above.

As the Information Commissioner’s blog of 1 February 2013 suggests, the
‘Most Wanted List’ included advice to ICO staff on how to communicate
clearly and effectively with customers in our written contact.

When preparing our previous response to the request for a copy of the
Commissioner’s blogs since 1 January 2013 we did carry out searches for a
copy of the ‘Most Wanted List’, but unfortunately this is no longer held
by the ICO.  As such, we are unable to provide you with a copy as
requested.

If you are dissatisfied with this response and wish to request a review of
our decision or make a complaint about how your request has been handled
you should write to the Information Access Team at the address below or
e-mail [1][ICO request email].

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response.  Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation.  To make such an application, please write
to our Customer Contact Team at the address given or visit our website if
you wish to make a complaint under either the Freedom of Information Act
or Environmental Information Regulations.

A copy of our review procedure can be accessed from our website [2]here.

Yours sincerely

Dear Information Commissioner’s Office,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Information Commissioner’s Office's handling of my FOI request 'Commissioner's Most Hated List'

Firstly, you refer to searching for the "Commissioner's Most Wanted List". I presume this is a typo, but perhaps you made the wrong search.

Secondly, it seems a bit odd that you wouldn't have a copy of this somewhere - have you asked Mr Graham himself?

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...

Yours faithfully,

Sam Morgan

29 January 2015

Case Reference Number RCC0569036

Dear S Morgan

Further to our acknowledgement of your request for a review, we thought it
would be helpful in the first instance to respond to some of the specific
points you have raised.

Firstly, you are correct when you suggest that our reference to the
Information Commissioner’s ‘Most wanted’ list was in fact a typographical
error, and both references to this should have read ‘Most hated’ instead.
All searches have therefore been carried out for the Commissioner’s ‘Most
hated’ list as requested.  Please accept our apologies for any confusion
caused.

Secondly, when dealing with the original ‘blog’ related request of 3
December 2014 we did carry out searches for those internal documents which
could no longer be accessed via the links given within the blog.  This
included the Commissioner’s ‘Most hated’ list.

The links to this document no longer work as, since February 2013, our
intranet has migrated from one content management system to another, and
shortly after migration the servers that housed the old site were turned
off.  Only content that was considered important, regularly accessed and
recent was migrated across to the new content management system.  Content
that was not brought across is now no longer held, including the ‘Most
hated’ list.

We also checked with other ICO staff, including the Information
Commissioner himself, but have been unable to locate a copy of the list.

Finally, it may also be helpful to mention that we have published on our
intranet a ‘keeping it clear’ guide. This contains all of our ‘rules’ and
‘guidelines’ for staff on how to write clearly and will, in all
likelihood, include all of the points which the Information Commissioner
included within his ‘Most hated’ list.  We’ve attached a copy for your
information.

Whilst we hope you have found this response helpful, if it is still the
case that you would like us to proceed with a formal review of our
previous response of 23 January 2015 please can you let us know, replying
directly to this email.

Yours sincerely

Dear Antonia

If you've asked Mr Graham then I don't think there's any purpose in going forward with an internal review - please withdraw my request.

I think it's odd though that something that sounded so personal (not corporate) and apparently heartfelt should have just disappeared.

Kind regards
Sam
