Dear Charity Commission for Northern Ireland,

Via FOI can you please list each of the Charity Commission Northern Ireland's Orders which were made by the Commission ( the Commission being those outlined in the Charities Act 2008, as amended in 2013) from 2011 until this date. Please list the Commissioners signature to each Order and the Board / sub committee meeting minutes to each decision. If the decision was reached in a sub committee meeting please name the sub committee and the reason why this sub committee's meeting minutes and Standing Orders are not on the CCNI website and the reason for this.

Yours faithfully,

Dear Petra Moore,

I am writing in response to your recent request for information (ref:
FOI20170426.1) and would draw to your attention to the provisions of
Section 8(1) of the Freedom of Information Act 2000 which states:

"8 Request for information.

(1)In this Act any reference to a "request for information" is a reference
to such a request which- .
(a)is in writing, .
(b)states the name of the applicant and an address for correspondence, and

(c)describes the information requested. "

As we are considering refusing the request as vexatious or repeated, the
Commission is therefore entitled, in line with guidance issued by the ICO,
to seek to confirm identity in order to determine if the request is valid.
The Commission is also mindful of its need to comply with its duty under
the Fourth Data Protection Principle which states:

"4 Personal data shall be accurate and, where necessary, kept up to date."

The Commission is therefore asking you to provide verification of your
identity as soon as possible.

You can verify your identity by providing proof of identity using a form
as per
[1]https://www.gov.uk/government/publicatio....
This indicates you cannot use one form of identification for both name and
address. Please provide a clear colour photocopy or scan of identity
documents to Neil Wilson, Charity Commission for Northern Ireland, 257
Lough Road, Lurgan, Co Armagh, BT66 6NQ. Your data will be handled in
accordance with the Data Protection Act 1998. Alternatively you may in
person bring the originals to the Commission’s offices at 257 Lough Road,
Lurgan, Co Armagh, BT66 6NQ, by appointment, to be verified. Once your
identity has been verified the Commission will process your request in
line with the Freedom of Information Act 2000.

Kind regards,

You are respectfully referred to my previous email of 27 April 2017. The
Information Commissioner is very clear in stating that:

“16. In our view, the intention of the legislation is for the requester to
provide their real name so their request could be processed in accordance
with the requirements of the FOIA.

17. This is supported by the fact that there are circumstances under the
FOIA where a requester’s true identity can be relevant, for example, where
an authority is considering aggregating the cost of requests or refusing a
request as vexatious or repeated.”

The Commissioner’s guidance on Consideration of the identity or motives of
the applicant  also states that when determining whether a request is
valid it will be permissible for a public authority to enquire about the
identity of the requester if it has reason to believe that they have not
provided their real name.
