Dear Mr Gibson

Thank you for your email regarding your request under the Freedom of Information Act 2000. I am able to provide you with the following response and apologise for the delay in doing so.

Please find attached a schedule of the Council's Commercial property indicating its lease status. I also provide a link to the Council's vacant property list which is accessible on the Council's website via: www.cheshirewestandchester.gov.uk/proper...

With regard to site plans, the majority of lease plans are contained in the lease documents which are held by records management and due to the volume of records would take a disproportionate amount of time to retrieve. Consequently, the Council considers that this part of your request is exempt under Section 12 of the Freedom of Information Act 2000. This is because to comply with this part of your request would exceed the ‘appropriate limit’ of 18 hours based on the following calculation:

To locate, identify and extract the information requested (including recovering each file from records management).

807 records in the attached spreadsheet

x

2 minutes per record (lowest estimate)

= 1614 minutes equating to approximately 27 hours

27 hours x £25 (hourly rate) = £675.00

Please let me know via [Cheshire West and Chester Council request email] if you wish to proceed with this part of your request in full and I will advise you on how to make the payment. Alternatively, I attach a plan of the whole Borough highlighting the location of the Council's ownership of Shops, Industrial and Office premises. You may wish to consult this plan and the list of premises and decide which premises you are particularly interested in. If this is the case, please forward me the property address and reference number and I will arrange for this information to be retrieved. Please note that, where applicable, exemptions may be considered before release and, if any are applied, you will be advised of the reasons why in the Council’s response. The ‘appropriate limit’ may also apply to any further request.

I trust that this answers your enquiry.
