Subject: Commercial Property Enquiry

Thank you for your request for information of 12/11/2015 in which you asked the following:

Please provide information on the details of commercial properties owned by or under lease to City of Edinburgh Council.

Unfortunately, we cannot identify the information you have requested from the details you have provided. To help us meet your request, could you please provide the following with regard to each of your points below:

1. Address and Postcode: We would need to know precisely what you mean by 'commercial properties'. A specific list of 'commercial property' is not kept as the term ‘commercial’ is open to interpretation. E.g. is grazing land let to a farmer commercial, a lease of an electrical sub-station or the letting of a bowling or tennis club? We can provide a list of everything leased out or in by the Council, but to go through lists removing what could be considered non-commercial would be a time consuming exercise. The costs involved would be such that we would not be required to respond under the legislation. The costs would be deemed to be excessive.

2. Rateable value of property: Rateable values are already published online on the Scottish Assessors website at www.saa.gov.uk

3. The period of time the property has been vacant/let: This information is not recorded.

4. The managing agent used by the council: The Council manages the property portfolio internally. Only one property is managed externally (Atria) for a specific reason. The managing agent is JLL.

5. If let the trading name of the tenant: Only the name of the legal tenant is recorded and where this is an individual on a non-registered lease/missive, we would be prevented from releasing this under the Data Protection Act 1998.

On receipt of these further details, we will respond to your request within 20 working days. Please note that the statutory 20 working day deadline for responding to your request does not start until we receive the requested clarification from you.

If we do not hear from you within 40 working days, we will assume that you are no longer seeking the information you have requested and we will take no further action.
