Commencement Order - Section 57 of the Crime and Courts Act 2013
Dear Home Office
It has now been almost 10 months since Home Secretary Theresa May stated in Parliament that she would respect the decision by the House of Lords to amend Section 5 of the Public Order Act who had inserted an amendment to remove the phrase 'insulting' from this part of the Act.
Further, it has been almost 7 months, since this change was incorporated into Section 57 of the Crime and Courts Act 2013 and received Royal Assent.
Yet as a notification on the now defunct campaigning group "Reform Section 5 (Feel Free To Insult Me)" website suggests, this change of law requires a 'commencement order' by the Home Office before it becomes law.
According to occasional media reports, arrests continue to be made under this part of Section 5 of the Public Order Act, even though the amendment has received Royal Assent.
Therefore, please advise me of the following:
i) Does the Home Office intend to provide this 'commencement order'?
ii) If so, what are the expected timelines to do so?
