Command Team turmoil and Common Purpose

We're waiting for dennis fallon to read a recent response and update the status.

Dear West Midlands Police,
I note that your Executive Team is being shuffled around again and you are currently advertising for two new people to act as ACC`s at a minimum wage of over £103,000.

You were extremely helpful in my last request for information about the Executive Team I posted in August 2019 but some details still remained unclear and there have been several major changes since then which require clarification.

There is particular confusion in that you are apparently advertising for two new ACC`s when there are already at least two people already describing themselves as ACC`s on social media ,including officer Matt Ward who recently appeared on television as ACC Ward to comment on Black Lives Matter protests.
There have also been media articles warning about political ambitions of Common Purpose,similar in secrecy to the Freemasons, have apparently been selectively promoted into positions of power, and I was concerned to discover, via websearches, that the new Deputy Police and Crime Commissioner Waheed Saleem (appointed despite the objections of the Police and Crime Panel) and the new Deputy Chief Constable Vanessa Jardine (as well as CC Dave Thompson himself and the previous Director of People and Organisation Ali Layne-Smith) are all graduates of Common Purpose courses and may try to conceal the fact as confidential personal information.
In consideration of this complex situation I would appreciate posting a new FOI request for further clarifications.
FOI Q1.I note that the current Executive Team(ET),as displayed 22 June 2020,appears to be exclusively white and mainly female consisting of CC Dave Thompson QPM,DCC Louisa Rolfe OBE, ACC Vanessa Jardine, ACC Chris Johnson QPM,ACC Jayne Meir,Mike Rogers MBE,Iain O`Brian,Nicola Price,and Neil Chamberlain and that since my last request a further three women have disappeared from the ET, namely ACC Sarah Boycott,ACC Susan Southern,and temporary ACC Rachel Jones and DCC Rolfe has resigned to make a career move to the Metropolitan Police.Please confirm the termination date of the four above named officers who have left and the anticipated termination date of any others on the ET if known, and please confirm the names and dates of appointment of any other officers,such as ACC Matt Ward,who are not displayed as ACC on the website yet mention this role on social media or television interviews.
FOI Q2.DCC Louisa Rolfe, despite apparently still being in post, will be imminently replaced by the newly promoted ACC Vanessa Jardine.Please advise of the number, gender and racial identification of all competing officers who were interviewed for the vacant position of DCC, and advise if the PCC David Jamieson or anyone else were involved in the interviewing or appointment process.
FOI Q3.I appreciate that the Common Purpose training of CC Thompson and Vanessa Jardine was not at the expense of the West Midland taxpayer, but please advise how much WM Police have spent on Common Purpose training or activities during the past two financial years and the nature of the expenditure.
FOI Q4.Obviously the applicants for to the recently advertised posts of new ACC`s have not been preallocated to existing West Midlands officers and,with the closing date now having passed, please confirm the details of applicants for the posts in terms of gender and racial description and geographical location to understand the variety of candidates attracted to the roles.
FOI Q5.I note that the Specials Chief Officer,Mike Rogers MBE,still has the untrue descriptor "Biography coming soon" when he has apparently been a WMP volunteer for over 47 years,since the age of 18,whilst making his main income as a lawyer in Dudley and as a property developer.Please advise why his name only appears on the ET listing with a start date of October 2014, and what was his title before this date?
FOI Q6.Your FOI Officer Carl Bird appears to be working for HS2 Ltd, does Carl still work for WM police or has he moved his loyalties to HS2 entirely?

Today,Wednesday 1st July,WMP have finally deleted DCC Louisa Rolfe many days after she appeared on the Met Police website as their new AC,so that is an improvement.This slackness is not a result of standard inefficiency, ACC Sue Southern was recently deleted from the website the very day after she announced she was going.Officer Vanessa Jardine now appears alongside CC Thompson but she is still described as ACC not DCC and still has not provided a biography despite being with WMP over 12 months.Why all the secrecy?You cannot trust a Force that is not efficient or transparent.

Q1a. We can confirm that relevant information is held by West Midlands
Police. However, we are withholding that information since it is exempt by
virtue of Section 40(2) - Personal information.

Section 40(2) allows for personal data to be withheld where release would
breach the third party’s data protection rights. It would be unfair to
release this information where any person could be identified from the

Thank you for your response to my FOI requests which,unfortunately,seem to be excessively restricted and I am considering if a review is necessary.In the meanwhile, to resolve a few minor issues, I would like to take you up on your offer,quote,"If you require any further information, then please do not hesitate to contact me".You confirm that the interview panel for the new DCC comprised CC Thompson,Nicola Price, and Grace Ononiwu of the CPS, please advise if the same people comprised the interview panel for the 2 vacancies of ACC mentioned on your website.I note that on Friday 10th July DCS Mark Payne made a media announcement regarding hate crime yet on Monday 13th July he was announcing on social media that he was starting his first week as ACC for Local Policing.

These are only requests for further clarification, I am extremely disappointed that none of these senior appointments have appeared in the media due to your failure to issue press releases, especially considering the fantastic news that ACC Matt Ward is the first BAME Officer to appear on the Top Team since ACC Anil Patani in 2008 and that path of diversity and gender balance has eventually been reinstated.

To clarify your points with regard to ACC Payne:

 

Officer Payne is currently a Temporary ACC and was interviewed for this
role, which he started on the 13th July 2020.

 

On the 29th June 2020 it was announced internally:

 

Chief Superintendent Mark Payne, currently Head of FCID, will be joining
the Force Executive Team after being appointed to the position of
Temporary ACC. He will start in his new position on a date in July, still
to be agreed.

 

FOI captures information up until the time a request is submitted and as
your request was submitted on 23rd June 2020, this is the reason that it
was not included in my response.

 

With regard to your question:

 

“Please advise if the same people comprised the interview panel for the 2
vacancies of ACC”

 

This is not information that was requested in your original request and I

I am writing to request an internal review of West Midlands Police's handling of my FOI request 'Command Team turmoil and Common Purpose' and note that I shall have to issue a new request to expand upon the background of appointment of ACC`s being made without public notifications being issued.
Regarding this appeal I will provide reasons why I find parts of the response to be unacceptable and point out that the person conducting the appeal should be neither David Notley nor Carl Bird, if he is still employed in your department, as he is a subject within the request.

Appeal reference FOI Q1a,I wish to appeal that you are being unreasonably obstructive in trying to conceal the termination dates for ACC Sarah Boycott, ACC Susan Southern,and temporary ACC Rachel Jones who were very highly paid officers and therefore should be leaving with pride and not escaping out the back door.I can see no valid reason,other than neurosis, why you are treating this as confidential personal information as one consequence of being highly paid, apart from the very high pension entitlement, is accountability to the public.Other police forces are not reticent about such matters and although I am aware that the information may have featured in the random Tweets of the Chief Constable it cannot be reasonable to be expected try to dig out the information that way.I would also appreciate knowing what you fear would be the harmful consequences of revealing these basic facts.

Appeal reference FOI Q1b, I did ask "please confirm the names and dates of appointment of any other officers,such as ACC Matt Ward,who are not displayed as ACC on the website",I did request the date of appointment and I wish to appeal that your response does not include a valid date.

Appeal reference FOI Q4,i note that 6 applicants applied for the 2 advertised ACC vacancies and I requested to know the details of applicants for the posts in terms of gender and racial description and geographical location to understand the variety of candidates attracted to the roles. I am concerned that one or two of the applicants for the £103,000 posts failed to identify their gender or geographical location which I find to be strange and unacceptable for an application form that requires a high level of security verification.Please clarify if it was the same person that omitted their gender and geographical location and if omitting these details were optional or an oversight by the candidate(s).

I wish to appeal that West Midlands Police is a taxpayer funded organisation and senior employees should be accountable to the public.Mr Bird is/was a senior accountable person who worked together with the then Deputy Chief Constable to develop your restrictive Foi policy (compared to other police forces), and I identified his obstuctive attitude in his unhelpful responses to other people in 2012 and to myself in April 2019.He was WMP Foi Unit Manager in 2012 and although absent from WMP publications recently he still appears active on behalf of High Speed 2 Ltd regarding requests posted on this website.I have no objection to Carl having 2 jobs but the public are surely entitled to know if he is still Foi Unit Manager or if someone else has taken up the important role.

The force responded on 13/07/2020 under reference number 373A/20 and
provided the information requested with the exception of question 1a as
this information was exempt by virtue of Section 40(2) - Personal
information, and question 6 as the force would neither confirm nor deny
the existence of any relevant data by virtue of Section 40(5B) - Personal
information.

On 19^th July 2020 you requested further information, as follows:

On Friday 10th July DCS Mark Payne made a media announcement and on Monday
13th July he was announcing on social media that he was starting his first

I asked in Q1b to confirm the names and dates of appointment of any other

The force responded on 23^rd July 2020 and advised that Officer Payne is
currently a Temporary ACC and was interviewed for this role, which he
started on the 13th July 2020. The force advised that FOI captures
information up until the time a request is submitted and as your request
was submitted on 23rd June 2020, this is the reason that it was not
included in the response.

 

REQUEST

You have requested an internal review of the force response on the
following basis:

 

In relation to question 1a, You can see no valid reason why this is being
treated as confidential personal information.

 

RESPONSE 1a

The response has now been reviewed and the force maintains that your
request was responded to on a proper basis.

The information requested is the personal information of the 4 named
individuals, it relates to the contract between West Midlands Police and
those individuals who no longer work for them. Therefore, s40(2) Personal
Information is engaged.

Please be advised that any information released as a result of a Freedom
of Information request, in effect, is being released into the public
domain. Therefore, it could subsequently be published or would have to be
made available to any member of the public if it were requested.

Any information that relates to an individual, or from which an individual
could be identified, constitutes personal data and to release information
that constitutes personal data into the public domain, that has not
already been published, contravenes the Data Protection Act and GDPR. The
information that you have requested pertains to personal data of 4 named
individuals and therefore it is exempt from disclosure, the exemption that
applies to this type of information is Section 40(2) of the Freedom of
Information Act 2000.

 

However, in order to assist, I have provided the month and year that the
individuals left:

Susan Southern – April 2020

Rachel Jones – June 2020

In relation to question 1b, you asked for the force to confirm the names

RESPONSE 1b

The response has now been reviewed and the force maintains that your
request was responded to on a proper basis. Officer Payne started the role
of Temporary ACC on 13^th July 2020 and this information has been provided
to you.

 

In relation to question 4, You requested the details of applicants for the
posts in terms of gender and racial description and geographical location
and are concerned that one or two of the applicants failed to identify
their gender or geographical location.

You have asked that the force clarify if it was the same person that
omitted their gender and geographical location and if omitting these
details were optional or an oversight by the candidate(s).

 

RESPONSE

The response has now been reviewed and the force maintains that your
request was responded to on a proper basis. You requested details of
applicants who had applied for the posts and the information recorded on
the force recruitment system in relation to the applicants was provided to
you. However, in order to assist, I have been provided with further
information in relation to location and can advise that 4 applicants were
`WMP force area` and 2 were `non force area`. The `not stated` gender is
not held

In relation to if the gender and location details were omitted by the same
person, and if omitting details is optional. These questions did not form
part of your original request and therefore will not be dealt with as part
of the internal review.

 

In relation to question 6, You believe as West Midlands Police is a
taxpayer funded organisation that senior employees should be accountable
to the public. You believe that Mr Bird is/was a senior accountable person
and you wish to know if he is still the FOI Unit Manager.

RESPONSE

Your original request was for if a named individual was still working for
the force or if they had moved to a different company. The response has
now been reviewed and the force maintains that your request was responded
to on a proper basis.
