Comeback Complaints

Response to this request is long overdue. By law, under all circumstances, Scottish Public Services Ombudsman should have responded by now (details). You can complain by requesting an internal review.

Dear Sir or Madam,

"In the years 2003 to 2009 the SPSO has received 903 “comeback” complaints from the public about the decisions made by the SPSO.

Please can you provide copies of the SPSO’s investigation reports and responses to these “comeback complaints” for the period April 2008 to end of May 2008 under a Freedom of Information request.

The documents released by the SPSO should be redacted in terms of 38 (1)(b) and 26 (a) of the FOISA to protect the complainants identity."

YOUR RIGHT TO REQUEST A REVIEW

You have a right under section 20(1) of FOISA to request a review of the
handling or outcome of your request for information. If you wish to
exercise this right, you must write to the SPSO to request a review within
forty working days of receipt of this decision. In your request for a
review you must specify your name and address for correspondence.

YOUR RIGHT OF APPEAL

If you are dissatisfied with the outcome of any review carried out by the
SPSO, you have a right under FOISA to appeal to the Scottish Information
Commissioner. If you wish to do so, you must appeal to the Commissioner
within six months following the date of receipt of the review notice. The

Dear Ask,
Received notice on the allotted 20th working day, that the request would take longer to comply with. I was offered an apology and a statement that the information would be available from next week at the latest. I shall in this "one" instance only! accept the apology and await the information.
