Conwy Council,

I require a copy of all minutes of meetings of the Colwyn Bay Pier Task & Finish Group to date.

I also require a copy of any and all reports and documents produced or discussed at these meetings.

I will also require copies of all minutes of future meetings of this group (and all reports / documents discussed there at). Please advise whether you will act reasonably and provide these promptly after each meeting, or whether I will keep having to make more and more FOI requests in the future.

36 of the FOIA which is detailed below.

Section 36 is an exemption in relation to information the disclosure of
which may be prejudicial to the effective conduct of public affairs
(absolute for information held by either House of Parliament; for all
other information covered by this section, the public interest test
applies) This section applies to information held by any public
authority.

You are advised that for Local Authorities Section 36 is a `qualified
exemption' which means that any decision to withhold the information is
also subject to the public interest test. In such a case, if it is deemed
to be more in the public interest to disclose the information, it should
not be withheld.

In accordance with Council procedures in cases where a qualified exemption
and/or the public interest are to be considered, the issue must be put
before the Qualified Persons Group who will make the decision.

Dear Mr Hunt

As advised on the 9/8/2010 a meeting of the Qualified Person Group was
convened to consider your request.

You are advised that the group decided the S36 exemption, previously
advised of, should be claimed in relation to the disclosure of
information contained in any minutes/documents of the Task & Finish
group. The minutes and documents will contain frank thoughts and
discussion on how best the issues surrounding the pier should be dealt
with for the benefit of all.

The group also decided that the public interest in withholding this
information outweighs that of disclosure at this time. Any disclosure of
any free and frank discussions on the subject will only serve to inhibit
such discussion.

There is no internal review procedure following Qualified Persons Group
decisions so if you are unhappy with this response you should appeal
directly to the Information Commissioner's Office - Wales, Cambrian

Further to your enquiry dated 29/6/2009. After consultation with the ICO
reconsideration has been given regarding the information withheld at the
time of your enquiry. The passage of time has diminished the sensitivity
surrounding the issues and the relevant information is made available to
you as per the attached.

Some information contained in the attached has been redacted. This is
because it is deemed to be personal data as defined by Section 1(1) of the
data Protection Act 1998 which relates to the pier owner.

The council is unable to verify that you are in fact the pier owner
through communications via a public website, and is also unable to verify
that you would consent (or otherwise) to the personal data being published
on a public website.

Should you wish to have an un-redacted copy of the attached the you will
need to provide the council with proof of your identity and address in the
form of a valid driving licence or current passport and utility bill/bank
statement, together with a fee of £10. You may either come into the
Bodlondeb offices or post the documents to the Information Regulations
Unit, Conwy CBC, Bodlondeb, Conwy, LL32 8DU. It is recommended that
postage be by way of Recorded Delivery and once verified any documents
will be returned immediately by the same. Any cheques/postal orders should
be made out to Conwy County Borough Council.

If you are not unhappy with the information provided, you have the right
to apply directly to the Information Commissioner for a decision by

Please provide ALL information as requested.

Furthermore, please provide un-redacted copies. I will NOT be paying you £10 for this NOR will I be providing any personal documents to you. You have already accepted on numerous occassions that I am indeed Steve Hunt - if you do not accept this, then you are admitting to breaching the Data Protection Act 1998 in already providing personal information in numerous documents on this public website, and therefore open yourselves up for prosecution. You cannot have it both ways.

If you do not want to publish the documents un-redacted on this website, then you can send them by post to me at Victoria Pier (only I have access, and it would be a CRIMINAL OFFENCE in any case for another person to access my mail, as you are well aware), or send to my Lawyers (you have their address on file I'm sure)

Dear Mr Hunt

Thank you for your email dated 10/2/2011.

As per your original request dated 29/6/2010 all the relevant information has been provided to you with the exception of the redacted information for the reasons previously explained.

Section 1 (4) of the FOIA states that the information in respect of which the applicant is to be informed, or have communicated is that information in question held at the time when the request is received.

Should you require any subsequent information since the date of your original request then you will need to submit a new request which will be duly considered.

The council will not be providing un-redacted copies of the previous information to you for the reasons already explained.

Section 40 of the FOIA operates as a gateway to the Data Protection Act 1998
(DPA). Subject access requests are decided under the terms of the DPA. Third party
requests for personal information are decided in accordance with the data protection
principles, but within the overall framework of the FOIA.

Any request received from anyone for information that is considered to contain any personal data of which they are the subject is exempt from the FOIA under Section 40 (1).

Any request received from anyone for information that is considered to contain any personal data of a third party may be considered exempt from the FOIA under Section 40 (2).

As advised on previous occasions for a subject access request to be processed the Data Controller must be able to verify the identity of the data subject. Documents acceptable for this purpose are your driving licence or passport and one of the following: a utility bill/bank statement/credit card statement showing your address.

Section 7 (3) of the DPA states:

Where a data controller -

(a) reasonably requires further information in order to satisfy himself as to the identity of the person making a request under this section and to locate the information which that person seeks, and

(b) has informed him of that requirement,

the data controller is not obliged to comply with the request unless he is supplied with that further information.

It is not intended to enter into any protracted correspondence on this particular
issue and therefore any further correspondence, except for you providing the
information required as previously explained, will be regarded as repeated and will
not be responded to as per Section 14 (1) and 14 (2) of the FOIA.

Original documentation is required as photocopies are not acceptable. It is recommended to either bring them to Bodlondeb with a copy of this email or send them by recorded delivery to the Information Regulations Unit, CCBC, Bodlondeb, Conwy, LL32 8DU and once verified they will be returned to you immediately.

Your deliberate belligerence, as per usual, is noted.

As previously advised you have already provided numerous pieces of information that identifies me personally via this website. Furthermore, you have previously accepted I am who I say I am, and I have also proven this by submitting information back to you via this website that you have sent to me (and me only) directly by Royal Mail to Victoria Pier, thus completing a chain of information that only I could possibly know.

To say you are not satisfied that I am Steve Hunt is ADMITTING to a string of serious breaches of the Data Protection Act 1998 by releasing into the public domain data that is personal to me when you freely admit you do not think that the person writing this is the real Steve Hunt.

You cannot have it both ways Mr Smith, either you do accept I am Steve Hunt, or you do not - which is it? - your choice. Please answer this simple question.

Furthermore, a Subject Access Request has been sent to CCBC which requires, by law, the disclosure of all the above information where I am identified. Should you again illegally refuse to release this information, I shall again pursue CCBC through the Courts, at great cost to the local taxpayers - another unnecessary cost which will again be flagged up to the Welsh Audit Office in a future audit. Given how much trouble you are already in over the 2009/10 audit, I would suggest that is not a wise course of action to take.

What are you hiding Mr Smith? - what are you constantly so desperate to keep a secret? All those minutes should, by law, be readily available in the public domain already so the people who pay your wages can see exactly what you get up to behind your closed doors... so what's the big secret? If you've done nothing wrong, you have nothing to hide, do you?

You have not answered the question as to whether you still accept I am Steve Hunt or not (even though you have done so many times in the past, and still do in correspondence with the ICO).

In several submissions to the ICO you clearly fully accept that correspondence I have sent to you / comments I have made via this website IS from the same Steve Hunt who owned/owns Victoria Pier, Colwyn Bay. You fully admit we are one and the same, so why this pretense? - I submit it is purely vexatious on your part.

I ask you again to please clarify your position in order to save further litigation at cost to local taxpayers.

This (and other) invitations to clarify your position, as well as your correspondence with the ICO, will be cited in submissions to the Courts in action under the DPA 1998 should you choose NOT to clarify your position.

I also request that you provide the Chief Executive and Leader of CCBC with copies of the whole thread of this request, in order that they are fully aware of your irresponsible, vexatious actions.
