that are still showing on your website, which appears to be a in direct breach of The Company and Business Names (Miscellaneous Provisions) Regulations 2009. As well as information about who has consented to the confusion caused by these two companies remaining on your Register.

2011 where you have requested copies of information shared between
Companies House and the two companies College of Social Work and College
of Social Workers.

 

Please note that under section 45 of the Freedom of Information Act 2000,
we are bound by a Code of Practice to inform third parties of the fact
that we have received a request under this legislation to divulge
information that they have provided.  I am obliged therefore, to contact
the third party to inform them that a request has been received and that
we are considering disclosing copies of correspondence between themselves
and Companies House.  This gives them the opportunity to object to such
disclosure and provide reasons as to why they consider the information
should be exempt.  I should point out however that the ultimate decision
on disclosure lies with Companies House and not the third party. More

With reference to your email dated 3 November 2011 where you have
requested copies of information shared between Companies House and the
College of Social Work - 7152880 and the College of Social Workers -
7449792.  Please accept my apologies for the delay in responding. 

 

As you were aware under section 45 of the Code of Practice I was obliged
to inform the relevant parties of your request and ask for permission to
disclose their correspondence.  I can confirm that permission was received
from both parties therefore I have attached scanned copies of the
correspondence between Companies House and both companies.  You will note
that personal information such as names; signatures and telephone numbers
have been redacted, as this is personal information which is exempt under
section 40 of the Freedom of Information Act 2000.

 

You have also requested information on who has consented to the confusion
caused by these two companies remaining on the register.  If I may
explain, when a company is incorporated, there are no safeguards for names
which are as close as this, the names although looking similar would not
be caught by any of our existing name checks.  The senior company can
later object under Section 67 of the Companies Act 2006 if they feel the
name is the same-as their company name, as is the situation in this case. 

 

I hope that the above information fully answers your Freedom of
Information enquiry, but if you have any queries about this letter/email,

If you are unhappy with the service you have received in relation to your
