Dear Welsh Water,

I am making this request for information pursuant to the Environmental Information Regulations 2004.

In relation to Cog Moors STW please supply copies of records showing the occasions when the bypass operated ensuring dates and times, and volumes bypassed are included. Please also supply the documents/information showing when the ultra violet lamps within the bypass system were operated.

The request is limited to the last 10 years.

We write further to your request for information dated 7^th June 2021,
which we have been considering under
the Environmental Information Regulations 2004.

 

We believe that Dŵr Cymru Welsh Water does hold the information you have
requested. By way of explanation, there is not bypass on Cog Moors WwTW
and the only UV is on the storm discharge so this is how we have
interpreted your request when you refer to the term ‘bypass’.

Please find attached our extract from our Regulatory Bathing Water Return
that is submitted to NRW for Cog Moors WwTW which shows

•            Dates we were spilling got storm during the bathing season

•            Flow to storm

•            UV operation

You will note that some of the information enclosed have been redacted.
Those redactions have been applied in the interest of meeting our data
protection obligations by preventing the disclosure of information
identifying other individuals insofar as you have not previously been
provided with the same.

I am writing to request an internal review of Welsh Water's handling of my FOI request 'Cog Moors STW bypass incidents'.

The information supplied is limited to 'bathing months' but the request was not so limited. Please supply the information for full years.

I refer to your email of 27 June 2021, requesting a review of our response
to your environmental information request of 6 June 2021.

 

As per our response of 25 June 2021, your request was considered by
reference to our obligations under the Environmental Information
Regulations 2004 (“the Regulations”). We are not a public authority for
the purposes of the Freedom of Information Act 2000, but a similar right
to request an internal review exists under the Regulations. I have
undertaken a review and considered the extent to which our response to
your request complied with the Regulations.

 

We understood your request to mean that you only required details of the
occasions when storm data had been treated with UV. As such, the
information provided was limited to the bathing season as that is the only
period which the UV plant at Cog Moors WwTW operates. I agree that your
request was not limited in this way.  Nonetheless, due to the limited
operational period of the UV plant, we do not hold further data in
relation to volume or the operation of UV lamps. However, since 2017, we
have been required to record Event Duration Monitoring (“EDM”) data, which
records whether the storm overflow (bypass) is operating in 15 minute
intervals. Please find attached EDM data, and an explanatory note, which
could have been provided to you earlier.

 

I note your concerns regarding your understanding of the data provided
with our response. I understand that, in trying to supply all relevant
data, we provided you with additional information beyond that necessary to
deal with your specific request. Please find attached a simplified version
of our bathing water data. The 3 columns, from left to right, detail date
and time; the amount of flow recorded as it bypasses Cog Moors WwTW and
enters the UV disinfection plant; and the UV dose applied.

 

I hope my clarification and the further information is clearer and helpful
but please do let me know if I can be of further assistance. I can confirm
that, if you are not content with the outcome of this internal review, you
have the right to apply directly to the Information Commissioner for a
