Dear Commissioner for Public Appointments for Northern Ireland,

The Code of Practice for Ministerial Public Appointments in Northern Ireland as issued in September 2015 indicates at 3.50 that:

"The public announcement should be issued as a press release and should be placed on appropriate websites. The public announcement must also be copied to CPA NI at the time of publication."

I understand Professor O'Reilly was originally appointed as an Independent Member of the DFP Board on 10/08/2010 and that her initial period of appointment was for a period of 3 years. While Professor O'Reilly currently retains her position as Independent Member of the DFP Board Member and is currently Chair of the Departments Audit Committee at this time I am unable to identify any public announcement confirming her reappointment.

This is somewhat concerning however since it is a requirement of the Code of Practice for Ministerial Public Appointments in Northern Ireland that Public Announcements must also be copied to CPA NI. I would ask (i)that this communication is treated as a Freedom of Information request and (ii) that you disclose a copy of the documentation CPA NI received at the time the DFP Minister announced Professor O'Reilly reappointment to the DFP Board?

For the record it may be helpful that I draw your attention to the fact that on the 6 March 2016 I submitted a Freedom of Information request to the Department of Finance and Personnel seeking a copy of (a) a Press Release or (b) any other official confirmation issued either (i) by the Minister or (ii) on the Minister's behalf at some point in the summer/autumn of 2013 confirming that Professor O'Reilly term as an Independent Board Member had been extended for a further period of years.

You may also be interested to know that in its response issued on 8 April 2016 under reference FoI 2016-0181 the Department responded:

“I can advise that the Department has carried out a search which has revealed that no information is held.”

Finally I would ask that you acknowledge receipt of this FoI request and confirm, unlike DFP's responses to FoI 2016-0181, this request if not responded to promptly will at least be responded to within the days allowed by statute.

Thank you for your e-mail.

I can inform you that appointments of Independent Members to the DFP Board are not regulated by the Commissioner for Public Appointments for Northern Ireland (CPA NI) and are therefore not subject to the requirements of the CPA NI Code of Practice.

In line with this CPA NI received no documentation relating to the DFP Minister's decision to reappoint Professor O'Reilly to the DFP Board.
