Thank you for your enquiry of 15th January 2023 regarding a review of:
 
COAL 94/67 - Investigative reports: fraudulent pay-outs under the
Mineworkers Pension Scheme. Orderable at item level
 
We are unable to open this record because all of the information is exempt
under section 40 (2) (by virtue of section 40 (3A) personal data
exemption) of the Freedom of Information Act 2000. This means that we
cannot make the record open to you, or to the public in general.
 
The FOI Act gives you the right to know whether we hold the information
you want and to have it communicated to you, subject to any exemptions
which may apply.
 
Section 40 exempts personal information about a ‘third party’ (someone
other than the requester), if revealing it would breach the terms of Data
Protection Legislation. Data Protection Legislation prevents personal
information from release if it would be unfair or at odds with the reason
why it was collected, or where the subject had officially served notice
that releasing it would cause them damage or distress. Personal
information must be processed lawfully, fairly and in a transparent manner
as set out by Art. 5 of the UK General Data Protection Regulation
(UKGDPR).
 
In this case the exemption applies because the record contains the
personal and the sensitive personal information of a number of identified
individuals assumed to be still living, including details of fraud and
financial data. These individuals would have no expectation that this
information would be made available by The National Archives in the public
domain during their lifetimes; to do so would be unfair and would risk
causing damage and distress, which would contravene the first data
protection principle.
 
If you are dissatisfied with the handling of your request or the decision
which has been reached, you have the right to ask for an internal review.
Internal review requests must be submitted within two months of the date

I am writing to request an internal review of National Archives's handling of my FOI request 'Coal94/67 investigative reports'.

[ GIVE DETAILS ABOUT YOUR COMPLAINT HERE ]it is my understanding that criminal or fraudulent activity as occurred in the Mineworkers pension scheme and as a fund holder of the scheme (my personal pension monies)I feel I have a right to know what criminal or fraudulent activity as this affects my personal monies
and it’s safety ?
And I object to you protecting these people/person and why would that happen ?why are you putting the rights of this person/ persons before the rights of honest hardworking pension fund holders that put monies in to what was supposed to be a “ watertight pension fund”? Why would you protect the criminal/fraudulent person/persons before actual fund holder?and why indeed as this been hushed up in the first place ?who authorised its secrecy?Can I kindly ask for an internal review

Review of complaint about access request: Appeal against The National
Archives’ decision that information in the following file constitutes
exempt information under the Freedom of Information Act 2000:

COAL 94/67: Investigative reports: fraudulent pay-outs under the
Mineworkers Pension Scheme. Orderable at item level

We wrote to you informing you that we would review and respond in writing
to your request for an internal review by 10/03/2023.

Your appeal is still being considered and I have not yet finished my
review. I anticipate being able to respond with my final decision within
40 working days from the date of receipt – that is to say, on or before
12/04/2023. This is in accordance with the Code of Practice on Internal
Appeals:
