Closures of footpaths Hastings 364a, Hastings 364b and Hastings 417 in Ecclesbourne Glen Hastings May 2020 to November 2021
Dear Department for Transport,
East Sussex County Council recently applied for an extension of footpath closures for Hastings 364a, Hastings 364b and Hastings 417. The footpath closure have been extended from May 2020 to November 2021.
1. Please provide a list of all documents (including correspondence,emails etc) that were sent to the Secretary of State by ESCC as part of the footpath closure process.
2. Please provide copies of all documents (including correspondence, emails etc) that were sent to the Secretary of State by ESCC as part of the footpath closure process.

Thank you for your response.
I have followed your advice and sent the same request to DEFRA as advised.
DEFRA have stated that they do not hold the information and that it may be held by the Department of Transport (see below).
I fear I am going around in circles. Can you please confirm that the Department of Transport does not handle applications for closure of public footpaths.
My FOI to DEFRA https://www.whatdotheyknow.com/request/c...
received the following response:
"We are writing to advise you that the information that you have requested is not held by
Defra.
The exception at regulation 12(4)(a) of the EIRs, which relates to information which is not
held at the time when an applicant's request is received, therefore applies to the
information you have requested.
Regulation 12(4)(a) is a qualified exception, which usually means that a public authority is
required to conduct a public interest test to determine whether information should be
disclosed or withheld. However, the Information Commissioner's Office (ICO), who is the
independent regulator for requests made under the EIRs, takes the view that a public
interest test in cases where the information is not held would serve no useful purpose.
Therefore, in line with the ICO's view, Defra has not conducted a public interest test in this
case.
However, under our duty to advise and assist applicants in pursuance of regulation 9, we
can confirm that to the best of our knowledge the information may be held by the
Department for Transport.

Dear FOI-ADVICE-TEAM-DFT,
Further to my previous reply I can now conform that ESCC sent the application for an extension to footpath closures to the following email address "[email address]". This is the email address for the national casework team at dft gsi gov uk This appears from a google search to be a department of transport email address.
The web site for the nationalcaseworkteam states that :
"The National Transport Casework (NTC) team carries out a range of transport casework for the Secretary of State for Transport. The applications and orders cover a wide range of transport functions and fall under a range of acts."
If this does not come under the department of transport can you please advise which department need to be contacted.

I have received your request for information relating to closure of
footpaths Hastings 364a, Hastings 364b and Hastings 417 in Ecclesbourne
Glen, Hastings from May 2020 to November 2021. This will be handled under
the Freedom of Information Act 2000.
I can confirm that this request for an extension to the closure of these
footpaths was sent to this office and responded to. I will organise copies
of the documents you have requested. However, this may take a little time
as all of our staff are working remotely from home due to Covid-19. My
colleague Fiona McDermott will send the relevant documents as soon as they
can be prepared.

This file was causing problems even with our Egress system as it was still
too large to send.
The only way to send it was to print it as another Adobe file to get a
smaller file that would go through the email system.
