Dear Sunderland City Council,

Following the new decision by the Government to close the ILF
(Independent Living Fund) on June 30th 2015 and devolve funding to
Local Authorities, please could you answer the following
questions.

1: Will monies transferred from the closure of the ILF to your
local authority be ring fenced to ILF recipients in your area? If
no decision has yet been taken, what is the process and timescale
for this happening?

2: Please could you state the process and timescale for meeting
with current ILF recipients to prepare personal care plans for 1st
July 2015 onwards (bearing in mind the assessments at the Transfer
Review visits only indicate desired outcomes and do not produce an
actual care package).

3: Will you be making any special dispensation for allowing ILF
users to continue to employ their current & in many cases long
standing carers of many years, bearing in mind some may be paid a
higher rate than what LA's may usually advise and be family
members
too?

Dear Mr. Taylforth,

 

Please find below/attached Sunderland City Council’s response to your
Freedom of Information request.

 

1) The money will be ring fenced to meeting the needs of adults with care
and support needs, as we remain committed to ensuring adults are able to
be as independent as possible and that all eligible care and support needs
of the ILF recipients will continue to be met. 

 

2) The council has an officer who has specialist knowledge and has worked
closely with ILF and ILF recipients for many years. He is continuing in
that role to support the transition arrangements, along with social work
staff. The council commenced consultation with ILF users in May 2013 and
held three ILF Awareness Sessions. A further three sessions were held at
the end of October 2013 to ensure we had reached as many recipients (and
their carers) as possible in both Groups 1 and 2. These sessions were
supported by Carers Centre, Benefits and Assessment Staff and Social
Workers. For those customers who were unable to attend, a home visit
offered and undertaken where requested.  Shortly after the last session we
were informed of the decision by the Court of Appeal to stop the closure
of the ILF and were informed to destroy any info relating to Group 1 Users
with immediate effect.

Since being informed of the decision to resume the ILF closure programme
we have continued to attend ILF transition reviews. We have met with
representatives from the ILF to discuss various aspects of the closure. We
will be holding further sessions at the Civic Centre Sunderland - 3rd, 5th
& 6th Nov 2014 to update all ILF users. At the awareness sessions we will
be giving out our 'self assessment' document to Group 1 users who have not
been assessed by the Local Authority. We will be commencing all of our 
assessments/re-assessments prior to Jan 2015.

 

3) We would expect all personal assistants and carers to continue in most
cases. We are aware that in some cases ILF have allowed family members who
live in the same household to be paid carers but this was only agreed to,
with acknowledgement from the Local Authority. Direct Payment rules
already accommodate family members being paid as long as they do not live
in the same household (unless in exceptional circumstances). To date we
have not been made aware of any cases where carers financed by ILF have
been paid more than DP rate therefore we do not anticipate any problems in
this area. If there are any Personal Assistants being paid at a higher
rate we would look into the reasons why, e.g. may be providing specialist
care?.
