A freedom of Information request on Cllr Ann O’Byrne & others

1/ Please can the Liverpool council release all the past records of: Cllr Ann O’Byrne with her involvement in the Chinatown project – PHD1 – NPG Ltd and her payments from these companies from 2014/2016.

2/ Please also supply all past records of Cllr Steve Munby and any payments he was given as a consultant from PHD1 and or North point Global Ltd to approve and back this project in 2014/15

Please note Mr. Colin Ling did not receive any payments from Cllr Munby
3/ She and Liverpool Labour party was given a cash payment of £1,800.00 from PHD1 Ltd Samuel Beilin and Julie McInnes where the directors of this company, did she report this to the LCC?

4/ She (Cllr Ann O’Byrne) along with Cllr Steve Munby in 2014/15 had become consultants for:

Peter McInnes, North Point Global ltd, in Liverpool Chinatown was any payments recorded and logged with the LCC?

5/ According to Cllr Ann O’Byrne, (Julie McInnes) was also a member of staff at the LCC and
She also works for a Liverpool housing association, is this housing association linked or part of the LCC?

6/ Colin Ling, CEO of Liverpool based charity Chinese Wellbeing Association has said, he was asked to back and approve the Liverpool Chinatown project (North Point Global) by Cllr Steve Munby, Cllr Gary Millar along with Cllr Ann O’Byrne, has the LCC still held the records and meetings of this?

7/ Now will the LCC investigate the following councilors with regards to corruption
Cllr Ann O’Byrne. Steve Munby, Cllr Nick Small, or ask for the report on these persons?

Elements of your request comprise statement, comment and speculation which
may be considered defamatory or libellous in nature, identify or refer to
individuals and are being published by yourself through the public
'WhatDoTheyKnow' website.  

We would advise you to take prompt action to remove or disable access to
any information that is potentially defamatory or libellous in nature with
immediate effect.

Any individuals named directly or by implication within your request or
other information you may have published online reserve the right to issue

Response

To the extent that limited elements of your request relate to information
hold by the Council, our responses are as follows -

1. Please be advised that the Council has undertaken searches in respect
of data retained on servers operated by the Council. Remote and targeted
searches were conducted utilising a free-text search facility, using
grouped wording selections using terms relevant to this part of your
request. The following search terms were used, including -

 'Chinatown', 'Chinatown project', 'Chinatown PHD1', 'Chinatown NPG Ltd',
'PHD1', 'NPG Ltd' with specific reference to any meetings involving
Councillor Ann O'Byrne. These searches involved an examination of the
inbox and folders held on Council servers.

For the avoidance of doubt and for purposes of clarity, these searches
indicate that 2 meetings were held, both taking place on 26 May 2015.

Records indicate that the two meetings were individual meetings with X1
Developments and PHD1 Construction, the two companies seeking to progress
a development on this site. For the avoidance of doubt the first meeting
was 1.00pm-2.00pm and the second meeting 2.00pm-3.00pm. The decision to
select PHD1 as preferred developer was a decision taken by all present at
both meetings following and having reviewed the proposals presented and
not an individual decision of any individual No additional records of
relevance have been identified.

2, 3 & 4. The Council does not hold or process data relating to individual
political parties as these are independent local and national
organisations. The registered interests of individual elected members are
already in the public domain and reasonably accessible to you. In
accordance with our duty to provide advice assistance and guidance, we
would refer you to the following weblink - [1]#

5. The Council owns Liverpool Foundation Homes which manages a small
number of private residential properties. The Council does not own,
control or operate any other registered providers or housing association,
whether in Liverpool or beyond.

6. Records relating to decisions made by Full Council, Cabinet and
regulatory committees which include Planning Committee are already in the
public domain and reasonably accessible to you. In accordance with our
duty to provide advice assistance and guidance, we would refer you to the

7. This is a statement and comment and not a valid request for
information. If you have concerns relating to the conduct or behaviour of
individual elected members, you may choose to submit a complaint under the

The Council will not respond or comment further in relation to potentially
defamatory or libellous statements. 

The Council will consider appeals, referrals or complaints in respect of

previously involved with the response and we will look to provide a
response within 40 days.
