Dear Cooper Joanne,

The matter under question is not an "environmental issue" and does not concern the environment in any way.

It is a question concerning the statement of interests of a PDNPA Councillor and is purely an administration issue dealing with the administration of the PDNPA and NOT it's dealings with the environment.

As such it is not appropriate to deal with the matter under the Environmental Information regulations and the request should be dealt with as I requested, under The Freedom of Information Act.

You should note that the Environmental Information Regs Article 2(1) state that the information requested should only refer to matters directly concerning to the "environment".

“environmental information” has the same meaning as in Article 2(1) of the Directive, namely any information in written, visual, aural, electronic or any other material form on—
(a)the state of the elements of the environment, such as air and atmosphere, water, soil, land, landscape and natural sites including wetlands, coastal and marine areas, biological diversity and its components, including genetically modified organisms, and the interaction among these elements;
(b)factors, such as substances, energy, noise, radiation or waste, including radioactive waste, emissions, discharges and other releases into the environment, affecting or likely to affect the elements of the environment referred to in (a);
(c)measures (including administrative measures), such as policies, legislation, plans, programmes, environmental agreements, and activities affecting or likely to affect the elements and factors referred to in (a) and (b) as well as measures or activities designed to protect those elements;
(d)reports on the implementation of environmental legislation;
(e)cost-benefit and other economic analyses and assumptions used within the framework of the measures and activities referred to in (c); and
(f)the state of human health and safety, including the contamination of the food chain, where relevant, conditions of human life, cultural sites and built structures inasmuch as they are or may be affected by the state of the elements of the environment referred to in (a) or, through those elements, by any of the matters referred to in (b) and (c);

Definition of 'Environmental Information'
Environmental information includes information about air, water, soil, land, flora and fauna, energy, noise, waste and emissions. Environmental Information also includes information about decisions, policies and activities that affect the environment.

The Freedom of Information Act 2000 provides public access to information held by public authorities.

It does this in two ways:

Public Authorities are obliged to publish certain information about their activities; and
members of the public are entitled to request information from public authorities.

The Act covers any recorded information that is held by a public authority in England, Wales and Northern Ireland, and by UK-wide public authorities based in Scotland. Information held by Scottish public authorities is covered by Scotland’s own Freedom of Information (Scotland) Act 2002.

Public authorities include government departments, local authorities, the NHS, state schools and police forces. However, the Act does not necessarily cover every organisation that receives public money. For example, it does not cover some charities that receive grants and certain private sector organisations that perform public functions.

Recorded information includes printed documents, computer files, letters, emails, photographs, and sound or video recordings.

The existing entry as referenced in your request is current.  We invite
all Members to review their entries after the Authority Annual Meeting in
July; however, they are able to submit amendments at any time. Amendments
are published within five working days of receipt.

 

There may be occasions when a Member declares an interest in a specific
item discussed at a meeting of the Authority and these are published on
our website in the minutes of the relevant committee meeting.
