Response to this request is long overdue. By law, under all circumstances, Parliamentary and Health Service Ombudsman should have responded by now (details). You can complain by requesting an internal review.

Can you provide a list of all neonatolagists and paediatricians used as special advisors including their GMC numbers for 2013.

Can you please provide Clinical Advisor guidelines, protocol for ensuring they are qualified, impartial.

Guidelines for how to proceed when clinical advice clearly is substandard - for the complainant and for the assessment manager.

Please provide guidelines on how to proceed with an internal review. for complainant and for assessment manager

The number of cases not initially chosen for an investigation to commence but then do after an internal review.

The cost per report a specialist advisor charges. Are you able to stop payment when clinical advice is so obviously flawed and get them to take another look at the medical notes? He missed very important blood test results too. And his medical knowledge regarding the different types of dehydration was sub par.

Dear foiofficer,

Hi Aimee,

I need the checklist for all your data requests (handwritten?) -
headed "HEALTH SERVICE OMBUDSMAN INFORMATION REQUEST". The page
contains boxes where you 'tick' "discharge plans - provided / not
provided' etc.

This checklist would establish that the PHSO did in fact receive
all the notes, just as the emails between myself and Ellie clearly
show. I understand that you with held these because my Internal
Review request questioned whether the laboratory/blood tests were
removed by Morgan Phillips or the Clinical Advisor. The emails
between these two make fascinating reading - I particularly love
how she compliments him on his "exceptionally well written and
wholly persuasive" report.

This is the report that said my son had 13 ribs whilst humans
normally have 12 (!?) and seemingly void of any medical knowledge -
"Hypovolemia refers to a reduction in circulating blood volume and
shock is a clinical term that I will not expand here.." Strange as
hypovolemic shock is one of eight different types of shock. One
example as to why his name should have been disclosed when you sent
me the advisor report.

The missing blood tests did infact show a reduction in circulating
blood volume.

Another reason you should have disclosed his name is a quote from
the 'External Advisor Terms and Conditions.' "THE PRACTICE OF THE
OMBUDSMAN IS THAT ALL PROFESSIONAL ADVISORS ARE NOW NAMED IN FINAL
DECISION REPORTS TO COMPLAINANTS AND THE RELEVANT HEALTH
ORGANISATION" Perhaps you should forward this to Steve Brown as I
have previously mentioned, your blanket refusal to provide the
clinical advisor's name was a deliberate breach of the DPA. "

FYI - Please let Steve Brown know that the clinical advisor's name
and place of work was contained in my Subject Access Request.

And yes he is the author of "Avoidable pitfalls when writing medical
reports for court proceedings in cases of suspected child abuse" -
a shame he chose to write a report that is framed to suit the views
of the PHSO and not follow his own advice (see my previous email).
He even pops up in this article as an expert witness where the
parents won a Legal fight for the anonymity of clinical advisors to
be lifted - Lord Justice Munby agreed with their request and in a
landmark judgement in January this year ruled that expert witnesses
in family courts could now be named.

But the content of his report is fully understandable once you have
read about PHSO case worker "Will". He "constantly needs to use his
'influencing skills' as one of the fundamental aims of our work is
to achieve a positive result without having to go to a full blown
investigation." - No wonder you only investigate 1.4% of case
brought to you! Between his "influencing skills" and "wholly
persuasive" yet inaccurate clinical reports the PHSO system is
fully weighted in favour of the ...PHSO! Really, we are aware that
you look for causation in each complaint and in the absence of a
possible legal threat for compensation (where you offer a reduced
financial settlement compared to court awarded), the PHSO is just
not interested.

Where exactly is the first copy of my sons medical notes? The
location of the notes is queried on several occasions in your
emails - no one recalls sending the notes back to Kings College
Hospital. The notes were not returned to Kings and in an email they
question why you need a further copy of the notes. Clearly another
example of the PHSO's failure to comply with the Data Protection
Act.

I have written to the ICO about this matter.
