Dear Askham Bryan College,

As part of the Climate Change Agenda following COP26 we are compiling a list of Organisations who do not comply with current legal requirements under The Energy Performance of Buildings Regulations (England and Wales).

You have been noted [potentially defamatory material removed], specifically in respect of buildings containing air conditioning. Part 4 Inspection of Air Conditioning Inspections of the EPB refers.

Questions;

1. Were you aware of the Regulation?
2. Provide a time-scale in which you intend to comply? We will check for your compliance certificate on the open government database:
Find energy certificates and reports by postcode – Find an energy certificate – GOV.UK (communities.gov.uk).
3. If you do not intend to comply, why not?
4. Who is the Responsible Person at your Organisation?
5. Do you have a Sustainability Plan or Carbon Reduction Programme?

Dear Jessica,

I write further to our exchange of emails below.

I have made some enquiries with our Estates team and in answer to your questions:

1. Were you aware of the Regulation?

Yes, we are fully aware of the Energy Performance of Buildings Regulations (England and Wales) and in particular Part 4 that requires all air conditioning units with a cooling output greater than 12kw to have a TM44 certificate every 5 years.

2. Provide a time-scale in which you intend to comply? We will check for your compliance certificate on the open government database:

We have limited air conditioning on campus and believe that the few units we do have output less than 12kw and are therefore not covered by this particular legislation. None of the units we do have are linked as all are standalone. Furthermore, we employ external energy assessors to undertake Display Energy Certification for all of our buildings that require one. These are logged on the gov.uk website via Landmark. We will always aim to comply with any legislation as it commences and within recommended frequencies.

3. If you do not intend to comply, why not?

We certainly intend to comply with any legislation affecting our organisation. We will review our current certification in light of your enquiry and should we find that there are any omissions we will commission the requisite surveys.
