information as set out in italics below. Firstly, please accept our
apologies for the delay in responding. Following consideration of your
request, in accordance with the Freedom of Information Act 2000, I respond

As part of the Climate Change outcomes 2022 following COP26 and ongoing UK
climate change policies a list of Organisations who do not comply with
current legal requirements are being compiled under The Energy Performance
of Buildings Regulations (England and Wales), specifically TM44 Air
Conditioning Inspection Reports.
You have been noted [potentially defamatory material removed] and could be subject to fines and other
more serious implications.
Were you aware of the EPB Regulation on air conditioning?
Yes, the Council has recently commenced a new tender exercise to appoint a
contractor to complete these over the 5 year timescale. The Council has
identified the appropriate locations, of which, 15 were completed during
January 2017 and have recently expired. When the contract is awarded all
locations will be included.
2. Provide a time-scale in which you intend to comply and obtain a TM44
Certificate properly lodged on the government database? We will check for
your compliance certificate on the open government database: July 2022
Find energy certificates and reports by postcode – Find an energy
certificate – GOV.UK (communities.gov.uk).
3. If you do not intend to comply, why not? The Council is aiming to
become fully compliant by July 2022.
4. Who is the Responsible Person at your Organisation? The responsible
person is firstly the Chief Executive, supported by the local authority’s
management structure and Cyclical Project Manager.
I hope this response satisfies your request. If you are dissatisfied with
the handling of the request, under the Freedom of Information Act 2000 you
