Dear Brighton and Hove City Council,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'Class Divide'.
Please review the decision to redact and withhold information on the basis that this would necessitate the release of personal information. Further, that the release of this personal information overrides the clear public interest in this information.
The redactions you have applied to the supplied information are extensive. I find it hard to believe all of this falls within the definitions of personal information and certainly not to the extend it would fail the public interest test.
Furthermore the individuals listed in my original FoI have decided to mount a public campaign to change education in the city. If they have chosen to use personal information to further this case it would seem paradoxical for this to fail the public interest test - it has become the basis for policy formation.
I further note the significant length of time this request has been drawn out for, and it's relationship to the Council's decision-making on this very controversial issue.

We have now processed your request and I can confirm that we partly uphold
your complaint.

Taylor, who was only elected in May 2023, to the listed individuals.'
Our initial response
On the 19^th February 2025, we responded stating that this information is
held and that some of it was exempt from disclosure under section 40(2) of
the Act - Personal information.
Your internal review request
On the 20^th February 2025, you submitted the following email:
' Please review the decision to redact and withhold information on the
basis that this would necessitate the release of personal information.
Further, that the release of this personal information overrides the clear
public interest in this information.
The redactions you have applied to the supplied information are extensive.
I find it hard to believe all of this falls within the definitions of
personal information and certainly not to the extend it would fail the
public interest test.
Furthermore the individuals listed in my original FoI have decided to
mount a public campaign to change education in the city. If they have
chosen to use personal information to further this case it would seem
paradoxical for this to fail the public interest test - it has become the
basis for policy formation.
I further note the significant length of time this request has been drawn
out for, and it's relationship to the Council's decision-making on this
very controversial issue.'
Our internal review response
This internal review will consider the following:
• how the request for information was handled and the initial
response,
* whether the request was completed within statutory timescales,
* whether the relevant information was identified,
* and whether to uphold the original exemptions or whether
different or additional exemption(s) apply.
The initial response to your request was not sent to you within the
20-day statutory limit and therefore was not compliant under [1]Section
10(1) of the Freedom of Information Act (FOIA). For this aspect of your
complaint, we uphold and would like to apologise for the delay in
providing you with the requested information.
In processing your internal review request we have reviewed the contents
of the information held by the Council within the scope of your Freedom of
Information request to determine whether the exemptions cited had been
appropriately applied.
The exemptions in our initial response were as follows:
[2]section 40(2) of the Act - Personal Information
It has been identified that the document provided as part of our first
stage response was not clear. By way of explanation, the information
considered out of scope has been redacted as if it were exempt under
section 40 and no explanation was provided to show this differentiation.
This document has been reviewed and marked up clearly to show the details
identified as not being within the scope of your request.
All information that remains in black is considered exempt under section
40. I am satisfied following review of the documentation that what was
disclosed is everything in scope and that it has been appropriately
redacted, despite the lack of clarity in our first stage response.
Please find attached the amended version with the redactions retained as
it is considered that the privacy of those individuals outweighs the
public interest in disclosure and therefore the exemption is upheld for
this personal data.
We will be reviewing our redaction processes to ensure that it is clear
the reasons for removing any information, especially where something is
considered out of scope, rather than exempt. I am sorry for any confusion
this has caused and hope the amended version clarifies this matter.
The final decision of this review is that your complaint is partially
upheld.
The above concludes our internal review and we will now close this request
as of the date of this response.

the right to apply directly to the Information Commissioner's Office for a
