Dear SE Trains Limited,

I wish to to know how many times the 375 fleet are maintained since the government took over SE, I am particularly interested in the trains that serve Ramsgate via Medway towns to Victoria.

I would like to see the plans of the schedules and what is checked in a routine service.

Yours faithfully,

David Bain

Plans of Schedules and Details of Checks

We hold this information however it is exempt from disclosure for the
following reasons.

Plans of Schedules – under s43 of the FOIA information is exempt where
disclosure would prejudice a public authority’s commercial interest. The
scheduling and optimisation of maintenance activity is essential to
commercial negotiations with lessors of rolling stock and providers of
components. Disclosure could prejudice our negotiations with those
parties. The S43 exemption is subject to the public interest test, however
we believe the interest in disclosure is outweighed by the commercial
damage to the authority and the taxpayer

Details of Checks – We hold this information, however under s.38(1) of the
FOIA information is potentially exempt from disclosure if its release
would, or would be likely to:
(a) endanger the physical or mental health of any individual, or
(b) endanger the safety of any individual

Providing details of checks would disclose technical information which
could endanger the safety of passengers. The S38 exemption is subject to
the public interest test, however we believe the interest in disclosure is
outweighed by the risk to health and safety.
