Dear British Broadcasting Corporation,

I would like written clarity on the following under the Feedom of Iformation At 2000.

Please can you (the BBC) show me in writing as per any documents you have/hold on any format. The following...

A, Any copy of any paper work/legislation that clearly shows in writing it is not an offence to have/own equiptment that "IS CAPABLE" of recieving a LIVE signal?

To include the BBC's stance on equiptment that is capable of recieving a LIVE signal (all manufactured TV's are) but the BBC's position on the individual using this eqiptment for other viewing purposes ie: CCTV, games consoles or PC monitors?

In short is it an offence to own any equiptment that is capable of recieving a signal but it is not in use to recieve a LIVE SIGNAL? Please provide documentation including legal references to such legislation.

B, Could I have a copy of the BBC's writen guidance/guidelines on obtaining a search warrant to include what burden of proof the BBC needs to show a magistrate to obtain such a warrant? Also to include copies of any forms that TVL are required to fill in to apply for a search warrant?

C, Could I have a written breakdown of the number of warrants issued within County Durham in the last 18 months to include the reasons for eachs request to the magistrates?

D, How many cases within County Durham were brought in the last 18 months?

E, Of those in D how many plead NOT GUILTY?

F, of those that pled NOT GUILTY how many were found innocent?

G, How many times in the last 18 months has the BBC been held accountable for wrongfully applying a search warrant?

H, How many of the issued search warrants were signed with "wet ink"?

Yours faithfully,

Dear FOI Enquiries,

please could you answer simply yes or no is it illegal to own a TV set and NOT use it for live TV although it is capable of recieving a live signal as all manufactured TV's are.

An analogy would be I have a Ferrari and it "COULD" do 170 MPH do I get speeding tickets when its parked on the front? NO was the answer from the Police under FoIA 2000, please could the BBC reply with a simple Yes/ No reply as Durham Constabulary did?

Yours sincerely,

Dear [Name Removed],

To answer your further query below in relation to your FOI request (RFI20140653). The FOI request gives applicants a right of access to recorded information held by public authorities, however, whilst requests may be phrased as a question, public authorities are not required to create information which did not previously exist, in order to answer that question.

As your below request does not ask for any recorded information held by the BBC, your correspondence has not been treated as a further request under the FOI Act. However, if you would like to request under FOI some information held by the BBC, please let us know, specifying as clearly as possible the information you wish to access, and we will process your request. You can see tips on requesting information under FOI here http://ico.org.uk/for_the_public/officia...

As stated in our response to you on 28th May 2014, we can confirm that recorded information which answers your query regarding the legal basis of the requirement to hold a TV Licence, and pay a fee for it, is already published on the TV Licensing website at http://www.tvlicensing.co.uk/about/foi-l... . Please note that the website has been recently updated and we would advise that you refer to the information under the heading, “Why do I need a TV Licence?”

Yours sincerely,
