Clarification regarding Land and Road Markings

Dear Newham Borough Council,
I am writing to seek clarification and information regarding the status of land and road markings on WoodGrange Road, specifically the area situated between No. 17 Khan's Fish Mongers and No. 15 Manson’s Pharmacy.

1. Status of Land Ownership
I would like to ascertain whether the land immediately before the metal gates in this area is public land under the management of Newham Borough Council, or if it is classified as private property. This clarification is critical as it directly impacts the enforceability of the private parking company’s claims.

2. Single Yellow Lines
Additionally, I have observed single yellow lines painted on either side of this area, leading up to the main road. Could you confirm if these road markings were installed by the Council? If so, does this signify that the land is public highway maintained by the Council? According to the Traffic Management Act 2004 and the Road Traffic Regulation Act 1984, road markings such as single yellow lines on public highways are typically the responsibility of the local authority.

3. Installation of Private Notices on Public Lamp Posts
It has come to my attention that a notice from the private parking company has been affixed to a public lamp post in this area, claiming the land to be private. Could you confirm whether the Council received and approved a planning application for the installation of this notice? As I understand it, under the Town and Country Planning (Control of Advertisements) (England) Regulations 2007, any advertisement or notice placed on public infrastructure requires explicit planning consent.

I kindly request the Council’s position and any supporting documentation regarding:

Ownership and maintenance responsibilities for the land in question.
Council authorisation for the single yellow lines in this area.
Any planning permissions or approvals granted for private signage on public infrastructure.
This information will greatly assist in resolving the dispute. I appreciate your prompt attention to this matter and look forward to your response.
