Clarification of right turn ban from Swan's Nest onto the A3400 Banbury Road
Dear Stratford on Avon District Council,
Under the Freedom of Information Act 2000, I would like to request the following information;
a) Can you clarify the existence of a right-turn ban from Swan's Nest onto the A3400 Banbury Road, Stratford-upon-Avon. Is the sign shown at the junction to ban road users turning right and travelling in a south-easterly direction on the A3400, or to remind road users to not turn the wrong way along the dual-carriageway that forms the A3400 at this junction?
b) Provide a copy or full text of the Traffic Regulation Order that covers this restriction.

Warwickshire County Council do not hold the TRO information. Their response being "This is because it is likely, due to the length of time that this TRO has been in place, that it was created by Stratford District Council during the period when they managed district highways".
Please can you attempt to check your records as laid out by the FOI request rather than provide the stock answer that you do not manage highways.

I am writing to request an internal review of Stratford on Avon District Council's handling of my FOI request 'Clarification of right turn ban from Swan's Nest onto the A3400 Banbury Road'.
Although Stratford on Avon District Council are not currently responsible for highways they have been in the past and therefore should hold relevant records regarding traffic orders made at the time. Rather than supplying a canned response an effort to locate relevant information should be made.

I refer to your request for an internal review as set out below.
According to my records, a further request for the same information was submitted on 5th October 2018 and responded to as follows:
Thank you for your recent FOI request. From what we have been able to establish the sign has been in place since before our formation in 1974. Prior to that I understand that Stratford Borough Council was the Highway Authority for the area and when this was dissolved their records would been divided up and passed over to the relevant authority. Stratford on Avon District Council have never been a highway authority as, since Local Government reorganisation in 1974 the highway function has been provided by Warwickshire County Council. If there are any records relating to this sign they would have transferred to the highway authority i.e. Warwickshire County Council. I have discussed this matter with some of my team who have lived in the area for sometime and it has been suggested that, in their opinion, the 'no right turn' sign referred to at the Swan's Nest Lane/A3400 junction is there to remind drivers not to turn right onto the wrong side of the short dual carriageway section, it is not there to ban the right turn onto the A3400 in a south-easterly direction. I don't know if this helps you at all. I am sorry that I have been unable to supply the information requested but I hope that this explanation is helpful.
Therefore, please advise if you still wish to pursue an internal review. I must however point out that the time period for requesting an internal review has expired. However, I will consider the matter further if you are able to provide reasons for the delay.
