Dear NHS England,

For Clares Law to work, NHS staff need to record, protect and document the injuries suffered by victims of Domestic Violence;

A) Between (i) 2004 and 2006 (ii) 2007 and 2009 (iii) 2013 and 2015 what guidance, training and reviews were conducted to ensure that NHS staff including A & E staff, GP surgeries and Coroners best ensured the safety of women ( and men) who were struggling to escape Domestic Violence due to issues beyond their control?

B) Following the launch of Clares Law, has the NHS progressed a Health and Safety review to ensure that victims of Domestic Violence do not become victims of NHS maladministration and errors by NHS staff, GP's, A & E staff too?

C) Provide a copy of your policies and guidelines for NHS staff informing the police and social services about children or child carers at risk of Violence from a parent?

“For Clares Law to work, NHS staff need to record, protect and document

Well, I have no "rights", your team are fully aware that I have already been down that route. I would not have been a victim of perjury by 2 sets of NHS lawyers since 16th October 2015 if the ICO and PHSO had both been fit for purpose.

Manchester Coroner;

Earlier this year, when the Manchester Coroner, Nigel Meadows, released the Witness Statements relating to the death of Nicola Davies in March 2004, it demonstrated that the NHS, the victim's family and the police would have been in no doubt that the relationship (with the father of her son) had been violent.

Manchester Hospital A & E Department;
So when the most recent girlfriend of the same man, lands up in A & E in August 2004 due to his violence against her, what protocols should have been adhered to when she approached a wide range of NHS agencies from the North West to Suffolk between 2004 and 2015

PERJURY;

I refer you to the start of my original FOI on 24th March 2017;

Human Rights;
You see, if your staff are not bothering to log the injuries or requests for help, how can the victim access justice in a timely fashion, as is their basic human right?

NHS England does not hold information in relation to your request.

 

A) Between  (iii) 2013 and 2015 what guidance, training and reviews was
overseen by NHS England  to ensure that NHS staff including A & E staff,

were struggling to escape Domestic Violence due to issues beyond their
control?

 

NHS England has no role in overseeing the training, education or
governance of Accident and Emergency staff, or of Coroners.

 

General Practitioners (GPs) are professionally required to ensure that
safeguarding is part of their ongoing training and education. Each Named
GP within a district works with all the local practices to identify
learning needs, disseminate local learning from Domestic Homicide Reviews
and Serious Case Reviews, facilitate multiagency working and support
safeguarding education. Safeguarding training and education is integral to
the legislative requirements of safeguarding, and as such, GPs are
required to undertake training regularly to maintain their skills and
competencies.

 

Oversight and governance of this process would be undertaken by the
safeguarding team within the local Clinical Commissioning Group (CCG) to
ensure that compliance adhered to local policy and contained learning from
local cases as identified above. GPs are required by NHS England as
contract holders to self-certify that they are compliant with all elements
of their contracts, which includes the requirement to ensure all staff
employed are trained in all aspects of safeguarding vulnerable people. As
part of their revalidation discussions, GPs will give evidence of their
professional training and education; this will include safeguarding.

 

NHS England work collaboratively with the Care Quality Commission who
inspect general practices where safeguarding practice is reviewed. Working
with NHS England, the Royal College of General Practitioners has created a
safeguarding toolkit that references domestic violence. This toolkit is
designed to support the training and education of GPs. GPs and all other
health practitioners use the Safeguarding Children and Young People: Roles
and Competencies for Health Care Staff, Intercollegiate Guidance (March
2014) to ensure that they are trained to the correct competency level for
the role that they undertake. A Best Practice Guidance document for Adult
Safeguarding is to be published in the next two months.

B) Following the launch of Clare’s Law, has NHS England progressed a

Clare’s Law is a scheme allowing police to disclose to individuals details
of their partners’ abusive pasts; this was extended to all police forces
across England and Wales from March 2014.

 

Every request under Clare’s Law is thoroughly checked by a panel made up
of police, probation services and other agencies to ensure information is
only passed on where it is lawful, proportionate and necessary. Trained
police officers and advisers, which may include Independent Domestic Abuse
Advisors, are then on hand to support victims through the difficult and
sometimes dangerous transitional period. NHS England has no role to play
in this work. Any health or safeguarding work needed to support the panel
would be provided by the local safeguarding team at the CCG.

 

As such, you may wish to redirect this part of your enquiry to individual

NHS England safeguarding team have a work programme focused on Domestic
Abuse, part of this work is to review the current practices for Domestic
Abuse support and identify any gaps from a health perspective.  A recent
SafeLives report has been presented to the National Safeguarding Steering
Group and regional safeguarding teams reviewing the findings. 

 

 

C) Provide a copy of your policies and guidelines for NHS England staff
when informing the police and social services about children or child
carers at risk of Violence from a parent?”

 

NHS England staff and those working within local health systems would be
subject to local safeguarding policies and procedures agreed by local
safeguarding partners which will include the local authority, police and
CCGs.

 

NHS England has a safeguarding policy that is current under review. This
policy supports colleagues at a national level, and gives some guidance
about how to deal with safeguarding issues from a national perspective. If
NHS England is aware of issues for staff members they would follow normal
local safeguarding policies and procedures.

You were in no doubt that I sought to view the policies and guideline that were in place since 2004. By now, under UK data law, you should have provided me with the "at risk guidelines" that staff (employed under the NHS logo) could have referred to between 2004 and 2012.
