Clapham Park Road TMO Exemption
Dear Lambeth Borough Council,
1. Has the 20 metre rule been used to issue PCNs for alleged contraventions at the Clapham Park Road bus lane?
2. Have any other rules apart from the 20 metre rule been used to issue PCNs for alleged contraventions at the Clapham Park Road bus lane, if so what are they?
3. Please send me a copy of the written instructions given to enforcement staff concerning the issuing of PCNs for alleged contraventions at the Clapham Park Road bus lane.
4. Have enforcement staff ever been given written or verbal instructions on how to apply enforcement at Clapham Park Road bus lane without unfairly penalising motorists and which specifically recognise that:
a. There is a TMO exemption allowing motorists to cross the bus lane to turn left (confirmed in decisions by London Tribunals (formerly PATAS).
b. It is not possible to cross the bus lane safely in less than 20 metres because of the island at the traffic lights.
5. What distance back from the end of the bus lane at Clapham Park Road does Lambeth Council consider that it is permissible to cross the bus lane safely under the provisions of the TMO exemption that the council has issued allowing motorists to cross the bus lane to turn left?
6. What distance back from the end of the bus lane at Clapham Park Road does Lambeth Council consider that it is not permissible to cross the bus lane under the provisions of the TMO exemption that the council has issued allowing motorists to cross the bus lane to turn left?
7. Have enforcement staff been made aware of the distances in your responses to paras 5 and 6 above prior to this TMO request and if so when?

Our Response
1. Has the 20 metre rule been used to issue PCNs for alleged
contraventions at the Clapham Park Road bus lane?
Yes, the 20 metre rule has been used by Lambeth Council to enforce the bus
lane at Clapham Park Road.
2. Have any other rules apart from the 20 metre rule been used to issue
PCNs for alleged contraventions at the Clapham Park Road bus lane, if so
what are they?
No, no other rules have been used to enforce the bus lane at Clapham Park
Road, other than the legislative framework for civil traffic enforcement.
3. Please send me a copy of the written instructions given to enforcement
staff concerning the issuing of PCNs for alleged contraventions at the
Clapham Park Road bus lane.
Please find attached a copy of the staff CCTV Training Manual for Parking
and Traffic Restrictions.
4. Have enforcement staff ever been given written or verbal instructions
on how to apply enforcement at Clapham Park Road bus lane without unfairly
penalising motorists and which specifically recognise that:
Enforcement Staff were trained to BTEC Level 2 Intermediate Award in CCTV
Camera Enforcement, which includes the main guideline of 20 metres to
enforce vehicles travelling in the bus lane. As advised, attached above
is a copy of the current CCTV Training manual.
4a. There is a TMO exemption allowing motorists to cross the bus lane to
turn left (confirmed in decisions by London Tribunals (formerly PATAS).
4b. It is not possible to cross the bus lane safely in less than 20 metres
because of the island at the traffic lights.
4a & 4b have been noted as your comments rather than questions to the
Local Authority.
5. What distance back from the end of the bus lane at Clapham Park Road
does Lambeth Council consider that it is permissible to cross the bus lane
safely under the provisions of the TMO exemption that the council has
issued allowing motorists to cross the bus lane to turn left?
There is no need to cross the bus lane in Clapham Park Road at the traffic
lights in order to turn left. There are another 2 lanes next to the bus
lane at this section of the road. The lane nearer to the bus lane is for
turning left. The bus lane at Clapham Park Road is dedicated for bus use
only (Emergency vehicles are also allowed). This is signed along the
road. As there are 3 lanes going towards Brixton at this junction there is
no need to use the bus lane to turn left at this junction.
6. What distance back from the end of the bus lane at Clapham Park Road
does Lambeth Council consider that it is not permissible to cross the bus
lane under the provisions of the TMO exemption that the council has issued
allowing motorists to cross the bus lane to turn left?
As stated above, the bus lane at Clapham Park Road is dedicated for bus
use only (Emergency vehicles are also allowed). This is signed along the
road. As there are 3 lanes going towards Brixton at this junction there is
no need to use the bus lane to turn left at this junction.
7. Have enforcement staff been made aware of the distances in your
responses to paras 5 and 6 above prior to this TMO request and if so when?
Yes, at the beginning of their contract, or after induction training, and
prior to commencing bus lane enforcements. See 5 and 6 above.
