Clapham Park Road Failure to Maintain Road Markings

The request was partially successful.

Dear Lambeth Borough Council,

The left arrow road marking at the junction of Clapham Park Road and Abbeville Road was allowed to become badly faded causing confusion for motorists as to which route to take when turning left at the junction. As a result some motorists crossed into the left lane which is a bus lane, a permitted manoeuvre under the TMO exemption for the bus lane. However, the council has issued PCNs to these motorists using the 20 metre rule.

The council did not maintain the left arrow road marking in accordance with Department for Transport Regulations which state that signs must give road users their message clearly and at the correct time. The message must be unambiguous and speedily understood. The left arrow has now been repainted.

What was the date the left arrow was repainted?

Will the council be cancelling all the PCNs in the pipe-line that were issued prior to the repainting of the left arrow, since to use the discretionary 20 metre rule when the council has failed to maintain a road sign which has led to the motorists entering the bus lane is clearly unfair if not unjust?

Dear Lambeth Borough Council,

I am writing to request an internal review of Lambeth Borough Council's handling of my FOI request 'Clapham Park Road Failure to Maintain Road Markings'.

Under the Road Traffic Act 2004 authorities should not raise PCNs at a location where traffic signs or road markings are missing or incorrect. The left arrow road marking at the junction of Clapham Park Road and Abbeville Road was very badly faded for a year prior to its repainting in Aug 15. PCNs should not therefore have been raised at this location and any that have been raised should be cancelled. The authority has not explained why it is not cancelling PCNs that should not have been raised. Failure to cancel these PCNs will result in many motorists paying fines that were unlawful.
