My husband is due for the ATOS medical exam shortly, if/when he falls the test and he has to appeal, there's a few questions I'd like to ask:
1) I understand that one cannot claim the ESA rate when appealing the decision, please can you tell me what you claim e.g UC/JSA when awaiting an appeal?
2) if you have to claim JSA whilst appealing because you have no other choice and no other income, what happens if:
(i)the JCP finds you unfit for work after being found fit by ATOS?
(ii) how will that reflect at the tribunal? When you had to claim JSA as there was no other income available to you?
3) how long will the claimant be left without money? when he appeals? What resources/help will be available? e.g. crisis loans/payments
