I would like to see information relating to the Cityfibre partnership with Peterborough City Council

Please provide the following:
1: Copy of the strategic partnership agreement (SPA) between the parties
2: Memorandum & Articles of Association for "Blue Sky Peterborough Ltd" which I believe is run by PCC
3: List of PCC properties which Cityfibre are occupying, the extent of that occupation & the annual revenue to the council for each one
4: Details of how many local sub contractors Cityfibre are using for the deployment to date
5: Details of how commitments made by Cityfibre in the strategic partnership agreement are being monitored & what sanctions exist for breach
6: A map showing locations where Cityfibre plan to deploy for businesses, the same for Residential
7: Details of how much public money is going towards funding the scheme
8: Copy of Schedules to the SPA
9: Details of any involvement from PCC Subcontractor, Serco, in the project, including how much of the council's annual payments to Serco are going into this
10: Details of any meetings with Cityfibre with the council, including dates/times/attendees & where possible, minutes.
11: Details of the authorisation process for this SPA within the council
12: Details of how much money, if any, PCC or BSP expect to receive from Cityfibre
13: Details of how \ why this route was chosen instead of BDUK

that occupation & the annual revenue to the council for each one

 

CityFibre rent office space in the Eco Innovation Centre which is owned by
the council. Office space is rented at commercial rents which are
available to view on the Eco Innovation Centre website. The rent CityFibre
pay is £1,050 per calendar month.

The strategic partnership is managed through a quarterly partnership
board. The agreement facilitates effective coordination of CityFibre’s
investment as an owner and provider of fibre optic infrastructure in
Peterborough. There is no commitment to provide optic infrastructure to
the council. There are no sanctions in this agreement.

Peterborough City Council does not hold this information.

 

7: Details of how much public money is going towards funding the scheme

 

There is no public money funding this scheme. The investment from
Cityfibre into Peterborough is their own commercial investment.

9: Details of any involvement from PCC Subcontractor, Serco, in the
project, including how much of the council's annual payments to Serco are
going into this

 

Serco have a separate contract with CityFibre to utilise the network that
CityFibre are building to provide connectivity to the council over their
fibre once it has been constructed. There is no money from the annual
contract with Serco going into the build of the network.

 

10: Details of any meetings with Cityfibre with the council, including
dates/times/attendees & where possible, minutes.

 

It is not possible to provide this level of information within the Freedom
of Information time limits for all meetings held with CityFibre. The main
attendee from the council side has been Richard Godfrey, ICT Strategy,
Infrastructure and Programme Manager who has met with CityFibre on many
occasions over the past 18 months. These meetings are not minuted. There
are separate project meetings occurring on a weekly basis that have
representatives from Serco, CityFibre and the council in attendance.

 

11: Details of the authorisation process for this SPA within the council

 

The SPA was authorised by cabinet on the 4^th November 2013. The agenda

12: Details of how much money, if any, PCC or BSP expect to receive from
Cityfibre

 

Peterborough City Council has deemed this information to be commercially
confidential.

 

The public interest test has been applied and in all the circumstances of
the case the council considers that the public interest in maintaining the
exemption is greater than the public interest in disclosure.  The council
acknowledges that there will always be a general public interest in
promoting transparency and public understanding about the decisions of the
authority, however in this case it is believed that the public interest is
greater served by preserving our ability to participate competitively in
the market.

 

To disclosure this commercially sensitive information, namely contractual
terms of the Strategic Partnership Agreement, would breach commercial
confidentiality. To release the information may also potentially harm the
ability of Cityfibre to succeed in any future competitive tender process. 
In addition, if details of how much money PCC or BSP expect to receive
from Cityfibre it may adversely affect any future commercial interests
that we may have.

 

13: Details of how \ why this route was chosen instead of BDUK

 

The council is already working with BDUK through the Connecting
Cambridgeshire project. The council has invested £3m in this project. The
CityFibre investment in the city is their own commercial investment.

 

14: Details of the compatibility of the Cityfibre project with BDUK
operations & commitments the council are bound to under EU procurement
legislation & BDUK Framework agreements

 

CityFibre’s investment in Peterborough is their own commercial investment
and is therefore not subject to BDUK framework agreements. Nothing in the
agreement requires CityFibre to build and operate ultrafast pure fibre
networks on behalf of the council or requires CityFibre to provide goods,
services or works to the council. The council consider that it complies
with all EU procurement legislation.

 

15: Locations other than PCC buildings where Cityfibre intend to place
cabinets, access chambers or PoPs
