Dear Traffic Penalty Tribunal,

I am making this request under the Freedom of information act 2000. I am aware that you are not mentioned in this act but that you were added in the 2011 consultation.

I would like to know more about the number of appeals you have dealt with in regard to penalty charge notices issued for the "bus lane" on Lendal Bridge in York.

The scheme started in August 2013.

For August 2013 and then for each calendar month since, up until February 2014, I would like to know the following figures for each month.

The number of appeals received by yourselves.
The number of those appeals where the City of York council chose not to contest the appeal.
Where the City of York council contested the appeal I would like to know how many appeals were upheld and how many appeals were denied.

Thank you for your email of 21 March 2014 requesting information under the Freedom of Information Act 2000.

With regard to your comment about Traffic Penalty Tribunal being added to FOI in 2011, this was proposed in the Freedom Bill 2011, which became the Protection of Freedoms Act. However, consultation with Traffic Penalty Tribunal over its inclusion within FOI has not yet taken place.

Therefore please note that the Parking Adjudicators constitute a tribunal and, in common with other tribunals, this tribunal is not a "public authority" as defined under the Freedom of Information Act 2000. Consequently, the duties created by that Act do not apply to the Parking Adjudicators, and other, tribunals.

Traffic Penalty Tribunal nonetheless makes publicly available a considerable amount of information in relation to the outcome of appeals.

The information which we make available can be found in our Annual Reports. These are available on our website, at the following address:

Dear Stuart Wilson,

Thanks for reply.

The reason for my request was to support my belief that York Council were using the 2nd appeal as an obstacle to steer people into paying up when the didn't need to. I have not heard of anyone having their 2nd appeal contested by York council.

I appreciate that you are not covered by the FOI act but my request was my way of seeing if York council are abusing the process and perhaps breaking the law.

Dear Stuart Wilson,

If an internal review is what it takes to get the information then so be it.

I hope you can see that my query forms the basis of what could be a very serious allegation against City of York council.

I also feel that, not withstanding your comments about your organisation not being subject to the FOI act, the public should have some access to the workings of your organisation.
As a publically funded body you have a duty to work transparently and in a way that shows your funding is being well spent and not misused, even if that misuse is being forced by a 3rd party.

If I am feeling that City of York council are misusing you as a "buffer" then I am sure that others are feeling the same way about other councils.

If after an internal review, the information is still not forthcoming, then I reserve the right to discuss this request with the information commissioner.

Dear Mr Hepworth

I refer to your further request for monthly statistics in respect of Lendal Bridge since August 2013.

As stated in my previous email, the Parking Adjudicators constitute a tribunal and, in common with other tribunals, this tribunal is not a "public authority" as defined under the Freedom of Information Act 2000. Consequently, the duties created by that Act do not apply to the Parking Adjudicators, and other, tribunals.

Furthermore, the adjudicators publish appeal statistics annually in aggregate and by council. The statistics for April 13 to Mar 14 have not yet been published.

We do hold a Public Register of all decisions which is available for inspection within office hours and two working days' notice. We can also send out a limited number of decisions, although usually we would need the case reference for this.
