Elaine McLean, Standards Commission for Scotland

Dear Ms Forth

I refer to your request in which you seek to be provided with the number of complaints made against Cllr Andrew Burns Leader of the City of Edinburgh Council. The Standards Commission for Scotland is not a complaints investigation organisation and therefore does not hold the information you seek. Under the terms of the Ethical Standards in Public Life etc. (Scotland) Act 2000 (as amended) the function to investigate complaints lies with the Commissioner for Ethical Standards in Public Life. I provide a link to the Commissioners website for your ease of reference http://www.publicstandardscommissioner.o... and have also forwarded your enquiry to the office of the Commissioner to consider your request and provide an appropriate response.

For your information the Standards Commission for Scotland is an adjudicatory authority and takes action following a referral being made by the Commissioner for Ethical Standards where, at the conclusion of his investigation, he determines that the Councillors' Code of Conduct has been breached by the person being complained about. Information about cases referred to the Standards Commission can be found on our website at http://www.standardscommissionscotland.o....

Should you require any further assistance please do not hesitate to contact me.

Yours sincerely
