I refer to your request for a review of the response provided to your
request for information dated 14th April 2011. Please accept my apologies
for the delay in responding to you.

 

Your original request was as follows (extracted):

 

I would like to request a copy of the statistical returns made by
Derbyshire CC to CIPFA statistics division that contains details of

library usage, book stock, performance data and spending. I would like
this information in spreadsheet format.

    

In its initial response the Council directed you to the Chartered
Institute of Public Finance and Accountancy’s (CIPFA) website for the
information as the Council had applied exemption 21 of the Freedom of
Information Act 2000; taking the view that the information was reasonably
accessible by other means. This exemption is not subject to the public
interest test.

 

As reviewing officer, I have now had the opportunity to evaluate the
initial response given by the Council.

 

You queried whether it was reasonable to consider that the information was
reasonably accessible by other means given that you would have to pay
CIPFA for this information while the Authority would be able to release it
without charge. Under s. 21(2) FOIA, the fact that a fee is payable does
not preclude the use of the exemption. Guidance from the Information
Commissioner states that whether a requirement to pay is reasonable
depends upon the level of the fee against the amount of information being
requested.

 

Having had the opportunity to review the information described in your
request; given that the Council provides CIPFA with the information
detailed in your request, I do not think it is appropriate to apply this
exemption in this particular instance.  

 

Please note that some of the information that the Council provides in
response to requests made under the Freedom of Information Act 2000 may be
subject to copyright protection.

 

Please find attached the latest return that we have submitted to CIPFA.

 

Please accept the Council’s apologies for any inconvenience caused by the
delay in supplying this information. I hope that now satisfies your
request for a review.
