I am lodging FOI on the following:

- How many courses do you deliver on behalf of/in association with the Chartered Institute of Personnel and Development (CIPD), including standard training, degree courses and post graduate education, on an annual basis (including names of all the training programmes/courses)?
- What is the annual income for MMU on the basis of CIPD association?;
- What is the annual income for CIPD on the basis of its courses/associated courses delivered by MMU?

The University has considered your request under the Freedom of
Information Act 2000.  We are unable to provide the requested information
on this occasion for the following reasons:

 

1.     Your request is not made for any public interest purposes but for
your own private interests and it is therefore deemed to be vexatious
under s14 of the Act.   ICO guidance sets out that: “The public interest
here means the public good, not what is of interest to the public, and not
the private interests of the requester.” We believe that we are therefore
entitled to withhold any such data held under s14 of the Act.

2.     Your request is not sufficiently clear, since we do not know what
you mean by ‘in association with’ or ‘associated courses’. 

3.     In respect of question 1, information about courses is published on
the University website and is therefore exempt from disclosure under s21
of the Act.  You can search the website yourself for courses with CIPD in
the title.  Of course the University also offers research degrees and any
of these may be considered to be ‘CIPD related’ depending upon the
specific subject matter chosen.

4.     The University does not calculate or record ‘CIPD related’ or
‘associated’ income, either for the University or for CIPD.   

5.     The University operates within a highly competitive environment in
the Higher Education Sector and would not usually release detailed
information about income received for specific courses or details of its
financial arrangements with external organisations as this would be likely
to cause harm to the University’s commercial interests, for example, by
releasing strategically useful information to competitor organisations
and/or by harming relationships with suppliers and business partners. 
Such information is therefore exempt from disclosure under s43 of the
Act.  The University meets the public interest by publishing annually its
financial statements and information about course fees.

 

With regard to the timescale for responding, you are correct that the Act
permits 20 working days.  However, in calculating the 20 working days, we
may take into account all UK bank holidays which are not ‘working days’
for the purpose of FOI.  Your request was received by the University on
7^th April 2020 and the deadline for our response on this occasion is
therefore 7^th May 2020.

 

If you are dissatisfied with this response and wish to appeal our
decision, please write to [1][Manchester Metropolitan University request email] giving your reasons for
appealing.  You must appeal within 40 working days of the date of this
email.  Under s5.3 of the Freedom of Information Act Code of Practice, we
are not obliged to accept appeals/internal reviews after this date.  You

Dear Michelle

I acknowledge receipt of your communication, and will be lodging an appeal on this with additional information provided on reason for appeal.

I am writing via the 'What do they know' website for reasons of public transparency (as that is the purpose of this site), but I will be appealing directly via email as there are some quite sensitive/legal matters underpinning this request concerning CIPD and MMU. I'm sure there is only so much dirty laundry your university would wish to be aired in public.

It is to be noted that refusal of FOI's must be notified by your organisation and on this occasion, prior to my sending a prompt email today (6th May) you have completely refused to update on your refusal to supply the FOI. That will be included in the appeal.
