Thank you for your request for information of 22 August 2019 which has
been logged as RFI 1576 and has been dealt with under the Freedom of
Information Act 2000. We confirm that Cheshire West and Chester Council
holds information relating to your request.

 

For the purpose of clarity your request has been reproduced below:

 

1.How many Fixed Penalty Notices has your council handed out in 2018 for
the littering of cigarette butts? – 475 Please note that this figure is
for all forms of litter and not just cigarette butts as we don’t not have
a recording system which differentiates between types of litter.
Compliance with GDPR and retention schedules means that Fixed Penalty
Notices (FPN’s) are destroyed when the data is no longer required, so it
is not possible for the requested information to be retrospectively
collated.

 

2.How many FPNs have not been paid within the allocated time frame, and
subsequently gone to court for littering cigarette butts in 2018? – 104
Please note that this figure is for all forms of litter and not just
cigarette butts as above.

 

3.How much is your FPN for littering cigarette butts? - £120 which must be
paid within 14 days but reduced down to £90 if paid within 7 working days
(these figures applied from 1st of April 2019 to all forms of litter and
not just cigarette butts. The 2018 FPN rates were: £80 which must have
been paid within 14 days but reduced down to £50 if paid within 7 working
days).

The Council considers that your request has been answered in full by
either confirming that information is not held, providing you with the
information requested, or explaining why any information has been withheld
and the reasons for any redaction. Where applicable, the Council has also
