Dear North Norfolk District Council,

This is a follow up to my previous FOI request.

This FOI requests copies of all correspondences (emails/meeting notes/letters) for Church Fields planning application be it under planning application references PF/17/1802 and/or PF/17/0696 and/or PF/16/0731 as follows:

1. Consultation Period Decision Making & Portal Submission
The consultation process for PF/17/1802 appears to have been arbitrary in respect to submission coming after the consultation period.

I respectfully request all emails/meeting notes/letters between all NNDC staff internally pertaining to the Church Fields planning application for the dates 1.11.17 to 5.1.18 that discuss consultation dates, extensions to consultation dates, and the acceptance or refusal of submissions after the 21st December 2017.

2. Negotiations of Off Site Play Equipment
Further to my previous FOI there are many emails/meetings/letters/quotations/proposal documents that are contained and made reference to within that FOI as a result of negotiations with Councillors from the Hoveton Parish Council and/or representatives of the Hoveton Parish Hall with NNDC staff, in particular Rob Parkinson. Therefore,

I respectfully request all emails/meeting notes/letters/proposals/quotations that refer to all negotiations regarding offsite play equipment between Rob Parkinson & Cllr Gourlay for the dates 30.9.17 to 5.1.18.
and
I respectfully request all emails/meeting notes/letters between Rob Parkinson and other representatives of NNDC and/or NNDC staff regarding NNDC negotiations on the offsite play equipment at the Hoveton Village Hall from 30.9.17 to 5.1.18

I write further to your request for an internal review received on 13
January 2018.

 

I have now conducted a review and would respond as follows:

 

I note that in the response to your initial request the Council has
signposted you to information which it considered fell within that
request, as it is entitled to do, however, you did not consider the
information provided did not satisfy your request and you sought
clarification.  This was then dealt with under a separate Freedom of
Information Request rather than clarification of your original request and
I note your concern arising from this would be the additional time you
would have to wait for any further information.

 

Having reviewed both your original request and your subsequent email I can
see why the officer did consider this second email included a request for
new information, as it deals specifically with the question of is ‘how
this benefit was conceived  and between whom was it negotiated’.    Having
also reviewed the Council’s response to this question I can see how the
officer concerned was further persuaded to treat it as a separate
request.  Whilst I appreciate it may be frustrating to you that it was
dealt with in this way, the Council is under strict obligations when
responding to Freedom of Information requests in terms of only providing
information which specifically falls within the ambit of the request. 
However, that said, I have included the response to your second email as
part of this review, rather than it be dealt with separately as an
additional Freedom of Information Response. 

 

Here is the response your second email as to what further or additional
information or correspondence the Council hold concerning whether
allotments had been negotiated with the applicant of the Church Fields,
Hoveton application (PF/17/1802) as a community benefit, which I hope
clarifies your concerns:

 

“There is no additional correspondence to that which [you are not already]
aware of.  The context to this is that financial contributions towards
allotments are not an additional “community benefit”; they are a necessary
automatic requirement for provision as a Section 106 planning obligation. 
An application of this nature is required to pay financial contributions
towards public open space, of which allotments form a part of the
calculation.  This is used to provide additional or enhanced allotments in
the same village or within approximately a 2.5km radius of the site if the
same village can’t use this money (e.g. if no land is available for new
allotments).  There are apparently no allotments in Hoveton so the money
is expected to be used to provide new ones if land is available and they
can be managed, or improve/extend existing ones in the above travel
distance.

 

The financial contribution is automatically calculated district-wide and
the applicant either agrees to pay them or has to justify not paying them;
whilst this was discussed briefly and verbally with the applicant there
was no need to do so in writing given that the application proposes to
make the payment so is “policy compliant” in that respect.  This is really
not an unusual occurrence.

 

I would be happy to provide any further correspondence re allotments when
the precise terms of the section 106 agreement are negotiated, but at the
moment there is nothing available”.
