Dear Sir,
 
Please see below the response to your enquiry under the Freedom of
Information Act (FOIA).
 
I would like to apologise for the delay in responding to your request,
which was due to making sure we had retrieved and fully assessed all
relevant information.
 

* Please publish any emails by Councillors referring to Covid 19 as the
'China Virus'

 
The information is exempt under sections 31 (Law Enforcement) 38 (Health
and Safety) 40 (Other People’s Personal Information).
 
Under sections 31 and 38, the council considers that making the
information publicly available would make groups of individuals more
vulnerable to crime and antisocial behaviour. The council is aware of
violence and antisocial behaviour having occurred as a result of views
relating to the origin of the virus. York has a significant group of
people who are likely to be at an increased risk if tensions are
heightened.
 
Whilst the council fully accepts there is a high public expectation of
transparency regarding the actions of Councillors as senior members of the
council. None of the emails received were sent by Elected Members acting
on behalf of the council and were in a Political capacity as Ward
Councillor. They are therefore only held by the council for the purpose of
assessing and dealing with any council function or service related issues
raised in the emails. It is considered releasing this information is
likely to lead to an increase in these tensions and the weight of public
interest is in maintaining the exemption.
 
Parts of the information are also exempt under section 40 as they identify
individuals in circumstances where there would be no lawful basis for
this. The individual’s details are only held by the council because they
have been included in correspondence with a Ward Councillor in a Political
capacity and would have no expectation of their details being made public.
 
Whilst personal information can be redacted the emails are exempt in whole
due to the exemptions at section 31 and 38.
