Dear Derby City Council,

Under the Freedom of Information Act, I kindly request the following information on eligibility for children’s services (for the purposes of this request, ‘children’s services’ relates to those referenced in Section 17 of the Children’s Act 1989):

1) Does your local authority use eligibility criteria to determine qualification for services for children?

2) If your local authority does use eligibility criteria to determine qualification for services for children:

i. when were they implemented?
ii. were consultations held around introducing them and, if so, what was the consultation period?
iii. please provide details of the eligibility criteria

3) If your local authority does not use eligibility criteria to determine qualification for services for children, by what criteria do you determine a child’s eligibility for such services?

Your request is being considered and you will receive the information requested as soon as possible, but in any case within the statutory timescale of 20 working days as defined by the Freedom of Information Act 2000 (FOI) and the Environmental Information Regulations 2004 (EIR), unless the information requested is subject to a statutory exemption on disclosure or the information contains reference to a third party. Please note that under EIR the deadline can be extended to 40 working days for large or complicated requests.

For your information, the Act defines a number of exemptions, which may prevent release of the information you have requested. Some exemptions are subject to a public interest test. There will be an assessment and if any of the exemption categories apply and any relevant public interest test is weighed in favour of withholding the information it will not be released. You will be informed if this is the case, including your rights of appeal.

If the information you request contains reference to a third party then they may need to be consulted before a decision is taken on whether the information can be released to you. You will be informed if this is the case.

There may be a fee payable for supplying the information in the form of disbursements. This will be calculated and you will be informed if a fee is payable. The fee must be paid before the information is released and the 20 working day time limit for responses is suspended until payment is made. You will have 3 calendar months to submit your payment.

Your request for information has now been considered and our response is
below:

 

1) Does your local authority use eligibility criteria to determine
qualification for services for children?

 

The Council uses the definition of a CIN outlined in S.17 of the Children
Act, 1989 to determine eligibility for services. However, we expect that
early intervention services e.g. children centres, youth support,
parenting courses etc to have been provided for children and families
first before more targeted services are offered. We also expect universal
and early intervention services to undertake assessments using the Common
Assessment Framework to determine what help and assistance children and
families need.

 

2) If your local authority does use eligibility criteria to determine
qualification for services for children:

    

     i. when were they implemented? - 1990/1991 when the Children Act was
implemented.  

     ii. were consultations held around introducing them and, if so, what
was the consultation period? - No consultation was held about the
implementation of the Children Act, 1989.

     iii. please provide details of the eligibility criteria - Please see
attached section of our procedures manual

    

3) If your local authority does not use eligibility criteria to determine
qualification for services for children, by what criteria do you determine
a child’s eligibility for such services? - Not applicable
