The names of all other staff are being withheld in accordance with section
40(2) of the Act. Section 40(2) of the Act states that the personal data
of a third party is exempt from disclosure if to do so would contravene
any of the data protection principles or section 10 of the DPA. “Personal
data” is defined at section 1(1) of the DPA as data which relate to a
living individual who can be identified from those data, or from those
data and other information which is in the possession of, or is likely to
come into the possession of, the data controller.
The two main elements of personal data are that the information must
“relate” to a living person and that the person must be identifiable.
Information will relate to a person if it is about them, linked to them,
is used to inform decisions affecting them, had them as its main focus or
impacts on them in any way.
The names of all staff constitute personal data because individuals can be
identified. Disclosure of this information would contravene the first
data protection principle, which requires that personal data be processed
fairly and lawfully. These individuals have an expectation that this
information would not be released without their consent. It is important
to note that consent is not a determining factor, however, it is a factor
that has to be considered when taking into account the reasonable
expectations of the data subjects. Also, these individuals are considered
to be junior staff and they are not in public facing roles or at a senior
grade. These individuals do not play an active role in making decisions
affecting the Council.

for an Internal Review. Internal review requests should be submitted
within two months of the date of receipt of the response to your original
request. If you wish to do this, please contact us, setting out why you

apply directly to the Information Commissioner (ICO) for a decision.
Generally, the ICO cannot make a decision unless you have exhausted the
Internal Review procedure provided by the Council.

Greenwich Council have contacted us to let us know that they "discontinued" their email addresses ending "@greenwich.gov.uk" in favour of "@royalgreenwich.gov.uk" on 17th February, and have not been reading any emails sent to the former addresses from then until 17th April.
Unfortunately they continued to accept email to these addresses without reporting any errors, even though it appears that they have not actually been reading these emails.
The ICO's guidance at https://ico.org.uk/media/for-organisatio... (para 27) makes clear that requests are received "on the day on which the request is [...] electronically delivered to the authority", the only exception being when an "out of office" message is sent in response.
We were using an "@greenwich.gov.uk" address until we heard from Greenwich Council on 23rd April as we had no reason to think it wasn't being read. Our mail logs show successful delivery of request mails to the same email server that is handling their new email domain.
In the interests of assisting Greenwich Council to respond as quickly as possible we have resent all the unacknowledged correspondence to them.
Although this resets the "due date" that the WhatDoTheyKnow site software shows, we consider that the true due date in law is based on the original request, i.e. 30th April 2015 in the case of this request.
