I write further to your request for information received on 30 July 2019.

Officers dealing with your request have asked for clarification on:

((How many cases did the Ombudsman deal with since 04/2017-present day
regarding education and what was the ruling of each, together with the
budget costs inflicted upon DCC?))   What do you mean by education? If it
is schools, depending on the issue, the ombudsman does not have
jurisdiction to investigate..  We will need further clarity before we can
provide the information.  Are you wanting to know how many complaints the
ombudsman has dealt with relating to SEND?

 

How many appeals were held 2018-2019?      What do you mean by appeals? 
Is this appeals to independent review panels for school transport or
school admissions or appeals to the content of an EHCP and/or requests?

 

How many Level 2 complaints submitted and, of these, how many were
upheld?     Do you mean all stage 2s or just for a given area?  ie is this
statutory complaints or corporate complaints.

 

In accordance with s. 1 of the Freedom of Information Act 2000, the
request cannot be processed until clarification has been received. The
deadline will be calculated on receipt of clarification

For clarification as requested -

1. the complaints to the Ombudsman is for all matters relating to education for which the Ombudsman has jurisdiction. However, it would also prove useful if you can supply details of SEND separately if possible. Thank you.

2. Appeals - NOT tribunals. I am happy to get the total regardless of reason as this is a comparative study.

3. Complaints - Level 2 complaints dealt with by Children's Services relating to SEND issues.

I hope that now clarifies the points you raised regarding my request, but if not, please contact me ASAP.

Dear Ms. Gardom,

Many thanks for your response to my FOI #593531. I think is best to write to you rather than speak again over the phone to clarify my concerns.

My request was sent on 30/07/19.
Tony Smith requested clarification on a couple of points, to which I responded on 11/08/19.

11/09/19 : Tom Mainprize then sent a response apologising for delay in responding to my request.
- "In Mr. Smith's absence I have been chasing up relevant officers who are providing the information in order to respond to your questions. I'm hopeful that a response can be provided by next week." kind regards, Tom Mainprize.
He assured me that he had discussed my request with the relevant officers in Tony Smith's absence from the time he was off.

19/09/19: I stated that I was still waiting for a response.

19/09/19: Julia Pearson write that my original request dated 30 July 2019 was unfortunately overlooked and stated, "I confirm that your request has NOW been submitted to the Children's Services department …."

Surely, both members of staff cannot be telling me the same information, when TM states he has been chasing up my request with relevant officers between 11/08 and 11/09 and then JP stating that it had been overlooked. That is my reason for requesting your internal review. I just want to know the truth.

On the 22/09/19 I asked JP that she would make sure another member of staff would give me information about the progress of my request and if that member of staff did not get back to me she would ensure she would get back to me herself.
